The 2009 guide, and the list based on state that the petitioner resides.

It means one should use the Poverty Guidelines in effect at the time the AOS is submitted, not the I-130. So if you filed the I-130 last year but filed the AOS this year, you follow the 2009 rules.

remember these figures are the 100% poverty guidelines. You must take the number and multiply by 1.25 for the required 125%.

Have a look at the I-864P - which are the guidelines for completing the I-864 and which displays the 125% for you. The new guidelines are now in effect (effective February 13, 2009), so if you haven't filed your Affidavit of Support yet - those are the guidelines you will use.
