I found the 2009 poverty guideline...Which ones should we follow?

The 2009 guide, and the list based on state that the petitioner resides.

Moving this to NVC forum, the I-864 for immigrant visa is required by NVC, not at the time the I-130 is filed.

Timeline

It means one should use the Poverty Guidelines in effect at the time the AOS is submitted, not the I-130. So if you filed the I-130 last year but filed the AOS this year, you follow the 2009 rules. :)

remember these figures are the 100% poverty guidelines. You must take the number and multiply by 1.25 for the required 125%.

Timeline

Have a look at the I-864P - which are the guidelines for completing the I-864 and which displays the 125% for you. The new guidelines are now in effect (effective February 13, 2009), so if you haven't filed your Affidavit of Support yet - those are the guidelines you will use.
