my fiance is in the military and is stationed in virginia which would mean to send our form to the uscis office in vermont.

BUT hes still a californian citizen.which uscis office do we have to send our petition to?

california or vermont?

You mail your packet to the Chicago lockbox and they will forward it on to the appropriate office.

Where he currently lives should be used to determine where to send to.

Unless he has a home in CA, I would use Virginia as the place I'm living in.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

This is not a correct statement for K-1 filers.

He should use the address he knows that he will receive mail at for the duration of the process. He'll get NOA1 (I-797) and NOA2 (I-797) and perhaps letters from NVC once they send the petition off. If he plans on being in Virginia the entire time and is assured he will receive mail there then he can use that address and file with VSC. If there is someone in CA (a parent perhaps?) whose address is more consistant then he should file with CSC.

he will definitely be living in va until july 2010 so the adress in virginia will definitely work but are you guys sure that uscis wont send our petition back in case we would send it to the worng one.i am just wondering since he is californian citizen.

They look where the petitioner currently lives in order to determine the service center.

If he lives in VA now, send it to Vermont. If he lives in CA, send it to California. The requirement does not say "if you are from..." :thumbs:

i was looking into it again myself and we will send it to vermont now.

i really hope that this wont take forever but who doesnt right? :blush:

i am sure i will have tons of more questions during thsi journey of ours and am really thankful that theres people that can offer help.

There is no such thing as a "California citizen". He's a "US Citizen" residing in Virginia. Perhaps he still has a California driver license. If he's in the military, he's not required to change it. That's about the only relevent California based issue.
