I apologize if this is in the wrong section. I didn't think it fit into any of the other sections though since we are not yet ready to file for AOS.

My fiance has just recently entered the US on the K-1 visa, we have 80 days left before our marriage deadline, but I was looking at NYS marriage license requirements and so on, and was reminded that we need my fiance's original birth certificate (or naturalization papers, which we don't have of course) in order to prove his age.

The problem is that we did not get an extra certified original copy when my fiance went to get the forms for his interview in Morocco. The original certificate that he got for the case was in the Consulate-issued packet that he gave to the immigration officers at his POE. Is there a way for us to have those original documents returned to us at all? I saw that there is a document on the USCIS website, G-884 (Return of Original Documents), but it looks like that is only for the return of documents when you are still in the application process. Am I incorrect in thinking that?

If anyone can help us out with some information, either in obtaining the original certificate or getting around it with some other form of age ID, we would greatly appreciate it.

You will not get another birth certificate here. If NY cannot identify him as over age 18 from his passport, well, what's the problem? Drive on over to Vermont where a passport is all the identification you need to prove you are over 18 and get married. You will only need to prove you are over 18 and sign an affidavit that you are able to marry (not married to someone else)

Things like birth cert are needed for other things in the USA, having extra copies is recommended, you may want to see if someone back in home country can get one for you.

As for marriage license, I would try using passport as proof of age.

I'd really rather not travel over state borders to avoid having to use his birth certificate as we will need it eventually anyway. :wacko: We have time to get ahold of what we need, so I won't be border-hopping as of yet, but I'll keep it in mind in case of emergency.

So the bottom line is that a copy of his birth certificate, sent by my fiance's family will be suitable? I do not need an original copy, just a photocopy will suffice? Or should we see if one of his brothers can get a certified copy and send it to us snail mail? Either way is fine, I assume that the latter choice is recommended? :thumbs:

You need to be talking to you local issuing authorities... they are the ones who will accept or not accept your documents...

You need to be talking to you local issuing authorities... they are the ones who will accept or not accept your documents...

Thank you. I called my town offices and they told me that it will be okay for me to just show his passport since the information on his visa is in English. I also looked up the required documents for obtaining a social security card and found that they will accept the passport in lieu of age proof since his birth certificate is not 'swiftly or easily obtainable' at this time. :thumbs:
