MORE ON FIANCÉ(E) I-129F VISAS

In continuation of our previous article Hold Up Of Fiancé(e) I-129F Petitions, the US Citizenship and Immigration Services (USCIS) has indicated in a July 13, 2006 press release that it will issue Requests for Evidence (RFEs) for more 10,000 Form I-129F Alien Fiancé(e) petitions currently being held at the USCIS’ Vermont Service Center. These RFEs, which will be based on a template, will be immediately issued to all petitioners.

As noted previously, all petitions filed on or after March 6, 2006 must be supplemented with additional information to satisfy the new evidentiary requirements established by the International Marriage Brokers Regulation Act of 2005 (IMBRA). The RFEs will direct petitioners to provide additional information including data pertaining to a petitioner’s criminal history (if any). Details on the waiver process for those affected by the new limitation for filings of I-129Fs are also provided in the RFE.

A very recent update on AILA InfoNet indicates that USCIS has published a revised form of the I-129F petition, which comports with the IMBRA. Although USCIS will accept the old Form till July 14, 2006, AILA strongly encourages the new form be used. If the old form is used between now and July 14, 2006, RFE’s may be issued in order to collect the additional information required pursuant to the new statutory requirements. Beginning July 15, the old form will be rejected.

although I thought it was never mentioned that only Vermont issues RFE's....I hope he isnt right though :(

Hi everyone ....I dont know if I can take this ####### anymore but, I check my status everyday online for my I-129F and it hasnt been touched like AT ALL ... I heard about the RFE ####### going on and havent gotten one of those yet but I am at 73 days since my NOA1 ....... I am sorry , I just have to vent cos they dont ever tell you anything and I signed up for the emails notification and havent gotten one yet... This just sucks :crying:

You´re 9 days ahead of me on NOA1 timeframe, hang in there! CSC is known for working a bit slower, and your waiting hasn´t been above the normal for CSC, just hang in there and you´ll hear something soon, also, you fall under IMBRA so you should get an RFE soon. If you don´t, start calling and asking about it.

The one stat Im not quite sure about here is 10,000 petitions I read somewhere that anually about 8 to 14 thousand people a year apply. Its only June and they already have a backlog of 10,000 in Vermont alone?

The USCIS statements implies that 10,000 people were affected by their IMBRA debacle. There is no way to know if this number is even remotely accurate - perhaps they meant to say that 10,000 people annually file I-129F petitions.

All service centers are affected since K1 applications were filed at Vermont, Nebraska, Texas and Califonia. Vermont does not have a 10,000 backlog.

There should not actually be a true "backlog" at this point since they have had several months to get caught up on paperwork while not working on I-129F applications. Instead, it's a delay based on waiting for RFEs to be sent and for them to receive the responses. Until this is done they are at a standstill and cannot move forward until the paperwork complies with IMBRA.
