Affidavit of Support... Should we get a Co-Sponsor, or will it work out this way?

Timeline

My fiancee makes $9/hr, and works 40+ hours a week, so I calculate his income like: 9x40x4x12 = $17280 Gross Income

The 2008 poverty guidelines say that for a household of 2 he needs to be making 17500.

So... 17500 - 17280 = 220 x 3 = $660 to make up in assets, and he does own a car that is worth some thousands.

Does this mean that we do not need a co-sponsor? If we are living with my sister, is she considered part of the household even though she pays for her own part of the house and is not related to him, nor a dependent?

I think I read somewhere that he might be supposed to own two cars, one that he puts as assets for the Affidavit of Support and one extra...

We have my car... which is really my sister's because it is at her name. Would my car count if what I think I read is true? If what I read is true then he wouldn't be able to make up the difference in assets...

You are shortchanging yourself four weeks of wages doing it the way you suggested.

You can't use automobiles to make up a shortfall in assets. You need to use liquid assets such as cash in banks, stocks, etc.

Thank you so much! Now his annual wage is 18,720 so he is over 125% of the poverty line :D

I'm very happy about not having to use a co-sponsor too, less papers to do! :)

But again... we don't have to count my sister as household right? She is paying for herself and is not related to my fiance at all, she is not his dependent.

I need to add something... my fiancee has a child that is 1.5 years old. Should we count him as his dependent too? He lives with his mom and they haven't gone to court to decide for visit rights or anything, so he is not paying child support, just buys stuff for him from time to time (It's not like he doesn't want to be more involved, he does see him 2-3 times a week, but his ex-gf doesn't like very much having to "share" the child)

The child was claimed as a dependent on his taxes for the year 2007, but this year the child's mom claimed him, so does that mean that my fiance shouldn't consider his child to be a dependent for now?

Yes, you can use autos. You just have to have more than one. (sell one, keep one).

You may not include the net value an automobile unless you show that you have more than one automobile, and at least one automobile is not included as an asset

To the OP -

anybody that he is financially responsible for must be included on the size of the household.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
