Hi,

I have been trying to find some where that I can get some info for a friend of mine, I hope someone here can help. I am wanting to know if there are any rights to the immigrant if someone has reported fraud, but it was done out of spite, not because of truth. Does USCIS actually test in some manner for the validity of a report?? Her husband for little over a year now has Conditional GC and has went through all the proper security checks etc, and will soon be lifting conditions. Is there anyway that they can contest/rebuttal, or something to the claim?? Does USCIS have to inform the person in question that there is i\an investigation and on what basis?? Is the person in question able to view the report and who has done it?? She is not sure if the threat made to her has actually gone through, but, she is scared, and does not want to loose her husband over a lie. Can someone shed some light on this??

There are no "rights" per se, but everyone is presumed 'innocent" until proven guilty.

As long as your friends can prove they have a valid marriage, and tell the truth, they should not have any issues.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks Bobby, that is what I keep telling her, she can surely prove all that, but she is just scared all the time. I will let her know what you said (same as I did), maybe it will make her feel better. The thing is also, she does not know if this stupid person has even followed through with his threat. Does immigration inform the person they are being investigated or will be??
