With a child on the way it may be safe to assume that the income guidelines for 3 will apply in the OP's case. That number is: $22,887.

I don't think the child will count for anything until she is born... that's also why I am doing all this process before she is born, because I think it might get complicated after we have her...

Somebody told me the way to calculate annual wages = $/hr x 40 hrs a week x 52 weeks in a year = Annual Wage

So my fiance earns $9/hr x 40 x 52 = 18,720

Poverty guidelines say that for a household of 2 you need to be earning $18,213 so I think we are safe :)

Now, somebody knows if I will be denied my AOS if USCIS doesn't think that's enough, or will they just call me saying "Hey you need a co-sponsor"?

Jeez, sorry! I just keep thinking of new questions...

This is about the Affidavit of Support.

My fiancee makes $9/hr, and works 40+ hours a week, so I calculate his income like: 9x40x4x12 = $17280 Gross Income

The 2008 poverty guidelines say that for a household of 2 he needs to be making 17500.

So... 17500 - 17280 = 220 x 3 = $660 to make up in assets, and he does own a car that is worth some thousands.

Does this mean that we do not need a co-sponsor? If we are living with my sister, is she considered part of the household even though she pays for her own part of the house and is not related to him, nor a dependent?

I think I read somewhere that he might be supposed to own two cars, one that he puts as assets for the Affidavit of Support and one extra...

We have my car... which is really my sister's because it is at her name. Would my car count if what I think I read is true? If what I read is true then he wouldn't be able to make up the difference in assets...

$9/ Hr comes to $18,720 Annually

The way to convert it is $9 x 40 x 52 (Which is the number of weeks in the year)

Good Luck!

Saludos,

Caro

They won't call and tell you anything. If you don't meet the requirements you will be denied.

And even if your interview is held before you give birth is it logical for the interviewer to ignore your obvious physical condition of being 9 months pregnant?

Don't set yourselves up for disappointment. If it looks like you will need a co-sponsor start working on it now.

But how does that make sense? Your income only applies to the situation you are in when you apply. What if my baby died being born? (hopefully not, I'm just saying) They can't include a baby, it's not born yet. I can't claim her as my child because she has no birth day, SSN, or even a legal registered name.

Please, someone can tell me more about this? Now you got me worried.

Not trying to be scary, just realistic.

Also, from our experience the AOS takes a few months from start to finish. Take a look at the AOS timeline info here on VJ: http://www.visajourney.com/timeline/aosstats.php?history=90

With the shortest wait time shown here it is likely that your daughter will be born by the time of your interview. The average days shown is 171 days.

So preparing to meet the requirements for the three of you just makes sense.

hello all,

I immigrated to US with F1 visa, my visa will be expired in Jul 2010. I got married with a US citizen last month, and now I start to do paperwork to apply for Green card. I'd like to ask about form I-693. I have already done medical checkup for the school. The checkup was done very quickly, not so much detailed. I am not sure if I need to do Medical Examination and Vaccine Record to complete form I-693. is it compulsory for all applicants?

There is also one thing that is bothering me. it is form I-864. It is supposed to be done by my husband, rite? the thing is he is student who has just graduated. both of us do not have a job yet. Can one of his parents fill the form? I mean, can his mom or dad be my sponsor?

thanks.

There may be a rule about how recently you had the medical exam. I believe that they have to be within a year of the filing.

Regarding the I-864, yes his parents can co-sponsor. Read through the instructions for all pertinent information.

Read through the I-130 guide here on VJ for starters.

Best of luck!

I-864 has to be filled by the petitioner and the co-sponsor. Even if he doesn't have any money your husband still needs to fill that paper in. It is very important that he does that.
