Hi all, extreme newbie here, and this has probably already been answered, i apologize for my laziness for not searching the boards.

question:

The time it takes to obtain K1 and K3 visas assuming are equal, if we were to marry in colombia and I fly back to the states, and wait for the process/paperwork to comelete would she be able to work sooner once arriving?

I'm not sure, but I think the K1 and K3 will process the same once she is here and you are married. Both have to apply for adjustment of status and request work authorization. I believe processing time for work authorization is about 3 months. Does anyone know anything different?

However, currently CR1's look like they are being approved at the same time as the K3. If you go the CR1 route, then she will arrive here with the green card and should be able to work as soon as she gets her SSN.

CR-1 can work a LOT sooner than either the K1 or K3.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

The time it takes to get a K1 is not equal to the time it takes to get a K3.

Yeah stupid move tho as you have to pay for the -131 if you don't file at the same time as the I-485.

Also takes up to 3 months to get the EAD.

CR/IRs get their GC and SSN within about 1 month of arrival. Thay can work way sooner. If done proberly CR/IRs only about 1 month lomget than K1s/K3s

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

K3 can get a work document without filing for adjustment of status.

But it still takes up to 90 days from the day of receipt to process it.

CR1 can work pretty much as soon as they enter the country.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Yeah coffee hadn't kicked in yet and I got the numbers mixed uo. Meant the form for EAD. I-765.

Also is "stupid" because once the I-94 expires you will be out of status and you don't apply for AOS and get caught you will be subject to removal proceedings.

Also if the petitioner should go belly up before the bene gets their GC they are heading back home.

A K3 visa can work quite well for a married couple where the foreign spouse is not quite yet ready to move permanently to the US. The multiple entry provision allows for frequent visits. And they can continue to work in their home country - something which can be a boon if they are the major bread winner.

Every couple is different and every case is different. If the couple are married and the foreign born spouse wishes to immediately make a permanent move the US, the CR1 is probably preferable to K3. But it's not always the 'better option all around'.

I agree. There are MANY reasons to choose the k3 path vs the cr1. the new people trying to figure out their options just get "the cr1 is better" shoved down their throats. I know it is their responsibility to research their own options, but that is what brings them to VJ.

I agree. There are MANY reasons to choose the k3 path vs the cr1. the new people trying to figure out their options just get "the cr1 is better" shoved down their throats. I know it is their responsibility to research their own options, but that is what brings them to VJ.

I do think it's a bit confusing to figure out which visa is best when one is just learning.

And I also think it's harder to decide (in the long run) what will be best for your future as a couple when you are separated and longing to be together.

Hindsight being 20/20, my best advice to anyone would be to try and put emotion aside and make a choice based on what is best for the both of you. Remember when making that choice that once you are reunited, the immigrant has a lot of adjustments to face. Perhaps working right away would help them adjust. Perhaps the ability to travel back and forth home for visits would help. Perhaps not having to face future stages of immigration would be cost effective and less worrisome.

My husband has not been home in nearly 3 1/2 years. We have finally been able to get our lives settled down and come up with the finances for a trip back home at the end of March. I wonder how that will be for him. I can remember when we were together on his 'side of the pond' that he was a bit different than he is here - leading the way to places I had not been, excited to show me his country. All his "American Dreams" have not come true - we are together but his career isn't what he had hoped for. I wonder what he will tell family and friends when they ask him about his new life in America...............

Real life happens after the visa journey is over. And like all marriages, there is bitter to go with the sweet.

Dunk your (whatever) in the coffee. The OP is immigrating and the CR1 allows for frequent visits and continued work in their home country as well.

Unless you're from Western Canada or the petitioner neglected to file I-130's for the kids, K3 is a poor choice. Of course, there are exceptions.
