I797 & driving licence

We're due to file AOS very soon, but I've got a potential problem with my driving licence.

I already have a U.S. driving licence but it's due to expire on the date my K-1 visa expires (2nd July). Upon speaking to the state DMV, they told me they can only re-issue my licence if they see an I797 form. Is this the first NOA I'll receive as part of the AOS application?

If not I could have a problem as I've become Americanised and don't know how to get around without a car anymore

I-797 is the "Notice of Action", it's the first approval you get, you should be able to see a receipt number starting with EAC- on it

I assume the first NOA for Adjustment of Status doesn't come with any sort of date on it regarding when I'm legally allowed to stay until, no?

No, it doesn't have that info on it. but your Visa and I-94 do have 'valid until' or expiry dates on them.

I'm not sure about it starting with an EAC, mine starts with a MSC.

My problem is that once the I94 expires (and also my visa effectively), I have nothing which says how long I can stay. In fact will I actually have *anything* which says I'm here legally?!

The motor vehicle department in Ohio just wanted to see the NOA from the application for AOS and that was good enough even if the I-94 had expired.

When I tried to apply for my Florida licence I was told they could not accept my first NOA as that only proved that I had applied for AOS and not that I had been approved to stay legally. I had to wait until my EAD had been approved and show them my EAD card. My licence will expire at the same time as my EAD.
