ummmm..is this a problem???!!

So i sent my AOS out on the 17th feb, they got it on the 19th...my cheque hadnt been cashed yet. Should i have been worried? maybe!

My father in-law called today to say that we had recieved a letter (our mailing add is still at their house even though we moved 3 weeks ago)

Im not sure exactly what it says but basically it said Rejection notice!! And i hadnt included Alien relative from or something and another 1 (my father in-law is over night mailing it to our add so will be able to look at it properly soon)

Has anyone alse come across this. I seem to be under the pretence that i just add these forms (they mailed the entire package back to us plus the cheque which HADNT been cashed) and send it all again.

But this rejection...is it bad. I thought they just sent an RFE if something was wrong! Rejection isnt the same as denial right?? My father in-law i think read out somethng about 'resubmitting the forms' so i think im good but i guess i just need a confirmation and support from people who may know about this

PS...i think my father in-law said that they were asking for form I130 but this is for a K3 visa isnt it??Not needed for AOS from K1?

Has anyone else had to file this?Are they getting mixed up? :wacko::thumbs:

It is weird that they are asking for an I-130. Maybe they are getting mixed up... when i sent in my package they sent me a RFE saying that I forgot to give something but I'm 200% sure I did. They probably lost it.

Just in case you should resend another I-130 (or a copy if you guys made copies of the whole form) and write on another piece of paper stating that you have already sent in your I-130 when you were dealing with the K3 Visa.

Did you send an I-864? Maybe they got confused between 864 and 130. anyways, send in the I-130 along with the RFE letter (unless I completely misunderstood, that you got a RFE instead of rejection).

6/07 - Forms got resent back to my Fiance because I forgot to sign some papers. [silly me]

11/28/07 - Got my K1-Packet 3!!! It was a headache to fill in the papers.

2/15/08 - Sent all documents and forms through express! I was close to the expiration date

3/27/08 - Interview letter!!! I was in the US with my Fiance so I couldn't come back in time, rescheduled appointment.

4/24/08 - Got my interview done :) Approved! Passport+visa+brown envelope will be sent within a week.

5/1/08 - Got my Visa!

~ Flying to US on 6/11/08.

~June 19 2008- Married!!!

7/25/08 - Sent in AOS: I-485 along with EAD, AP.

8/7/08 - EAD, AP, AOS touched.

8/19/08 - Got an RFE for I-485... Fixing it.

8/22/08 - Biometrics taken in Portland.

10/08 - Another Bio (for work authorization card).

-- received my work authorization card and advance parole papers in meantime--

1/15/09 - AOS INTERVIEW *faints* in Seattle, Washington.

2/2/09 - Green Card!

You need to send in the address change notifications ASAP. You are required by law to notify USCIS wihtin 10 days for the immigrant, and 30 days for the sponsor, or face deportation, jail and monetary fines.

I suspect that your forms were filled out incorrectly if they are rejecting them based on not having an I-130. Which you won't know for sure until you receive the package yourself and read the letter. No, rejection of the package is not the same as denial of application. You just need to fill the forms correctly, and re-submit them.

Did you marry within the 90 days allowed for the K1? If you married after 90 days (after the date on the I-94), you do need to submit an I-130 too, as you are no longer applying for AOS based on the K1, as it had already expired when you got married. Hope you get the forms soon and can get it sorted out!

10/13/10 - NOA1 date, received 10/18

Thank you to all answers! I did marry within 90 days of entering the usa..thats why im confused. Do i just send it iin anyway? or call them?

I also hadnt told them about my change of address. I tried but they said i needed a NOA for that and i hadnt recieved one for my aos. Unless they meant from the k1 visa....hmmmm

read this, you have to change your address whenever you move - not just when you have an application pending

They will reject the whole application if you left something that is a basic requirement out. They RFE if it's minor like the W2 forms to go with the tax return.

When you get to read the letter, maybe you will understand it better. Did you send a copy of your NOA2 notice for the I-129F. Perhaps it's a form letter and says Approval notice for I130 or I-129F and Dad just picked up on the first part, not knowing one form from another. Did you make a copy of the entire packet for your reference? You can see if you included all these:
