I am a bit confused about the new revised I-9 form as available on the USCIS website where the Acceptable List of Documents is concerned.

If my fiance plans for POE to be at JFK and he is successful in getting the EAD 90-day stamp, will my fiance be able to work in the USA (while he waits for the long-term EAD as he will apply for with AOS, AP)?

I especially would like to hear from people who got the EAD stamp at JFK after Jan 09.

Can someone please explain if he will/will not be able to work with the temp EAD stamp (while he waits for the EAD he will apply for later on with AOS)?

The accepted list of documents on the I-9 will change in April. A temp EAD stamp on a Valid I-94 will no longer be accepted unless the person has a Visa that is work authorized for a specific employer.

So K1 visa is not a work visa and does not name a specific employer so the EAD stamp will be of no use after the beginning of April.

Looking at the new revisions, I still see as List A acceptable documentation.

( 3 ) A foreign passport that contains a temporary I–551 stamp, or temporary I–551 printed notation on a machine-readable immigrant visa;

The machine-readable printed authorizations have been issued for some time to those authorized to work for specific employers, but they added the language to the revised list to include the printed version. I doesn't look like they have taken out the stamp language. It may be that JFK will eventually discontinue giving that stamp in favor of the printed version, but the stamp does still seem to be a legal proof for the I-9.

That's right.

The EAD "stamp" granted at some ports of entry is not the same as an "I-551" stamp.

K1's aren't eligible for such a stamp.
