Hello,

I would like to know what to do My fiance and I just got approved for our K-1 (NOA2) came 4 days ago. However upon sending in I-129F I was employed. Due to the economy I was laid off... the end of Sept. of 08. I'm on unemployement to this date now 5 months as we speak, and I can't find any job here in Orlando,Fl. not even fast food. I am willing to take whatever! So what happens now?What do I put for future income on the I-134 ? I don't recieve much unemployement due to being put back on an extention now for the year of 07;however that was a bad year for me work wise didn't make much money at all. 08 was better I made enough in 08 to sponsor him with a total of 22,500 for him , my son, and I a total of 3 people. But my income now to show proof for future support is way low. I guess what I'm asking is can we get denied upon his interview if my income is way below, what should I put for income, should I say I'm self employed now??? I don't know what to do...we're so close but so far in the same time it's scarey to think. I have pay stubs however there dated from most recent October of 08 clear back to January of 08, also my unemployement which is barely nothing. 510.00 a month....now for year 07 I'm getting. So you see what I meen. :crying:

It get's worst!!!! My paralegal that I hired to help me with all original paper work didn't make copies prior to sending out everything. And I see now that

my fiance will need copies of everything to take to his interview in Egypt. So what can I do fast to help this in any way . WE DO HAVE pics, passport visa stamp,my airline tickets to go and come back home,western union money transfers from me to him, a valentines day card I sent him,IM's that I saved,e-mails,my cell bill, both of our birth cert. But as far as any application paperwork we don't have copies of. I didn't even get my first NOA1 letter...receipt letter ever!!! I called asked for it the USCIS said they sent it and they can't make another duplicate so they asked me a bunch of questions pertaing to me and then gave me my receipt #. So I do have that much. I am sooo sorry to burden anyone with this but if anyone has the knowledge or experience to something as so crazy please help me. It's really hard to even breath!!!

I would ge a co-sponsor that is working and makes enough to sponsor your fiancee.

I find it really hard to believe a paralegal did not make copies. IN fact I do not think it is possible. I am about as certain as I can be they are concealing the copies from you. It is even harder to believe you didn't get a copy BEFORE you signed, but that is water down the sewer. Call the paralegal and inform them of your happy news and that soon your fiancee will be here. Explain to them you have just found out about the adjustment of status and ask what the fee will be for the AOS process. After they answer, and it will be probably 3 times what they ripped you off for the I-129f, demand your copies. They cannot do the AOS without it (not in practical terms) and it will reveal they are keeping your copies from you in order to jack you up for the AOS.

But hey, why shouldn't paralegals jump on this like the scumbag attorneys they work for? They know it isn't even a legal process, requiring no legal qualifications, why shouldn't they clean up also?

Also when you find out that the paralegal did nothing but fill in a few forms, about the equivilent of a Walmart job application, you will be really pissed off and not likely to use them for the even simpler AOS process.

In the end, you will probably not need the copies for the interview. VJ suggests you bring them, it is not a bad suggestion. But your I-129f file is forwarded to the consulate, they will have everything. You will need to bring only a copy of the I-129f, so relax and go get your copies, you should have those for your files, the paralegal DID make copy. If they refuse and stick to their BS story, then demand your money back and contact the BAR association of your state.

I agree that finding someone to help with the sponsorship seems to be the easiest way to handle the income issue. Any potential people that might be willing to help you?

I assume you have the Notice of Approval for your I129? That is the most important thing you need for the future.

We did K-1, not I130, but my husband didn't need anything for the interview process from the I129 packet I sent here. He had to take HIS Packet #3 paper work, and my support forms and evidence of my income (I can't remember the name of that form... I134?) Hedid take the original of his divorce decree because that had been an RFE issue for us, just in case they wanted to see the original... But nothing else... What did you think he needed to take?

I hope you can find someone to help you with sponsorship. I wonder if alot of people are in your situation with the economy in bad shape. I've met 2 other women in my state who's husbands recently arrived from Egypt and both of them have lost their jobs! This is really difficult since newly arrived husbands don't often have EAD's for quite a while when they arrive, and THEN finding work here is still another challenge for the newly arrived Egyptian husband!

Is $22,500 for 3 people enough to meet the support test? Maybe you will get a job before he gets his packet 3 papers together. We had to wait for my husband to send his Packet#3 until I did my taxes last year as I am self-employed and didn't want to risk sending the document without the most recent tax return. It also was taking him some time go get the $$ together for the expenses involved in doing Packet 3 (medical exam, tests, cost of the Visa, etc.) So chin up! Cross the bridges one at a time! :)

Hello, thank you for the information. As for the 22,500 for income sponsorship I made for 08, the paralegal that did the initial work stated that I just made it. I have been trying to get a hold of her and have yet recieved a call back, maybe she's out of town??? Anyhow I actually have'nt recieved the actual letter yet (NOA2). It was an email sent out by the USCIS stateing it was mailed out on the 24th. So I don't have all the steps that follows yet after this one. Does the cost vary for AOS, depending on what? By being here on this site which has helped a lot in the pass 2 days, I can see the paper work is nothing lol... I would say for sure I waisted money down the drainhahaha. So thank heaven for this site, and all the members within. I won't be needing a paralegal again that's for sure!! So it's usually about 2 to 3 more months process wise? Hi, thanks for responding. We are also in a K-1 as well, but I see that a I-134 (Affidavit of support) needs to be done for this next step.

I am still waiting for the actual approval letter I know it's coming cause the USCIS sent me an email to update me with case status.

But no steps are shown to let me know what is needed next. I'm learning as I go through this site actually. I had a co-sponsor lined up however

she also got laid off. So my question is in the interview my fiancee will have in Egypt, will they deny him cause my current income isn't enough as of now. I'm hopeing to land a job any job but it's a bit hard now. Do you know what the minimum income for 3 is to be without a co-sponsor? The paralegal

told me for me, my son, and my fiancee I needed to make in 08 taxes 22,000. And I actually passed it by 500.00. Do you know for sure if they are looking at last years taxes, along with future income to qualify him in interview? What goes on in the interview?? Thanks for all information you can help with.
