An Explanation Please???

I keep reading three things. People who abandon the K3 for the CR-1, abandon the CR-1 for the K3 and also people who state that if you receive the K3 first, do not abandon the CR-1 but return to the country for the interview once it is approved because it might be faster than applying for an AOS after she arrives in the country on a K3.

If she receives the K-3 Visa first, do we need to abandon the CR-1 process or is it still an option to continue the CR-1 for a more rapid change of status approval?

I have the understanding that the K3 is to get the spouse here quickly so that you may wait for the CR-1 staus together.

Help?

06/26/06 - I-129F sent to USCIS Chicago

06/27/06 - I-129F received by USCIS Chicago

07/??/06 - Uhhh...where is that darn NOA1?

Your understanding of the K3 visa is correct, Be sure to fill out the "NEW" form with the extra questions :thumbs: ..........I came here on a K3, we also still went with the CR1 & i returned to England for the CR1 interview!!

you will need an approved I-130 to AOS from K3, it wont make AOS any faster though :no:

so you do have choices, you can do both see which gets to the embassy first, if CR1 get there around the same time as K3, then the embassy will cancel the K3!!

Read the guides and learn, as your only in the very begining, soon you will know all you need to know :thumbs::yes:

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

My K-3 interview is in August, and my CR-1 application has not received a "case complete" yet. I intend to enter on a K-3 and then go back to Canada for the CR-1 interview.

brad,

A person who comes to the US on a K-3 must still become a Permanent Resident. There are 2 ways to accomplish this:

1- Stay in the US and apply to Adjust Status/AOS

2- Return to the home country when requested and attend an Immigrant Visa (CR/IR) interview.

When the K-3 interview and CR interview look like they will be close together, some people 'abandon' the K-3 interview and opt to wait for the better CR interview.

If the I-130 passes the I-1329f and reaches the Consulate first, there is no choice; the beneficiary can only have an Immigrant Visa interivew.

Your understanding about the K-3's purpose is correct. The difference is that the wait used to be 2-3 years not long ago. Now they are pretty much the same-same.
