hey everyone...haven't been on in a while!!! we filed my man's I-751, but I did not file AOS yet...how much trouble are we in? We got married in Jan of 07(I know). I thought we had up until his green card expires to file...I was wrong.....as usual

I am not working and money is so tight but....is it really bad that we haven't filed for AOS yet? does filing the I-751 buy us any time?

HELP!!!!

If you haven't filed for AOS then he doesn't have a conditional green card and you can't even send the I-751. He never adjusted status.

You may want to elaborate a bit - did he come on K-1 visa, you got married and never did AOS? How did he get a green card if you did not do the AOS? CR-1 visa?

:blink: You cannot remove conditions on a permanent residence you do not have.

If you did not file for Adjustment of Status, you cannot file for Removal of Conditions.

I think you're confused.

Your timeline shows that you were approved for AOS on 07/24/2007. That means your husband's greencard should expire sometime around 07/24/2009. You should be filing the I-751 within the 90 days prior to that (aprox. 04/24/2009-07/24/2009 double check the dates, as I'm not being exact).

Your timeline indicates you filed for and received the PR/Green Card (in July 2007) which means you'll need to lift conditions this year (as soon as sometime near the end of April; and before July/when current card expires). This is something you will definitely want to set aside money for - as you do not want that PR/Green Card to expire without having filed to lift conditions (I-751). :thumbs:

FYI - Terminology is everything - AOS/Adjustment of Status you've already done. Lifting conditions (of a two-year PR/Green Card) is what you will need to do.

All you need to send in is the I-751. No I-485 is needed.

Its a little early to send in the I-751. The earliest you can send it in is 90 days before the conditional greencard expires.

Okay, I'm a little confused too.

Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

Your notice talks about approval, but doesn't mention your receiving the green card in the mail within 60 days... did you? Did you get the green card? It seems as though the notice you have there is the same as mine, and for the same thing, but worded differently because it's a couple of years older. But the proof for that is whether your husband has his green card right now - does he?

I feel SO MUCH BETTER...I was starting to panic & with me only working part time i was going nuts!!!!! I feel so much better...I can ALWAYS count on my VJ peeps to set me straight! I have some time so I WON'T file the I-751 just yet...you are all rock stars!!!!! :thumbs::thumbs:

Okey doke. See, with all the adjustments USCIS makes to its wording and application rules and whatnot, these things seem to differ slightly year to year.

In that case, look at the date in July that the card will expire on. You MUST file for the conditions to be lifted within 90 days prior to that date, or your husband will be out of status and could face deportation. It's only January, so you have time. Don't panic!

However, if money is an issue, beg, borrow or steal the $465 and $80 biometrics fee. (Well okay, maybe don't steal. :P) But seriously, you need to file this when the time comes or all manner of headache will ensue.

hey stranger!!!!! how are you?

we have been living here loving life...not loving the economy, but loving life :whistle:

We just went to Dublin for two weeks & it was amazing...we are planning our BIG WEDDING on 12/31/09....it is going to be so sweet & we can't wait. Gavin has been working but he is still going on auditions all the time for acting roles. how in the heck are you doing? how is your man?
