In fact, neither.

You are a "legal alien allowed to work so long as you have permission from the DHS". Such permission is called an Employment Authorization Document, or EAD for short, and you will also require a Social Security Number.

I did not got my EAD permission yet, I was about to send the form this incoming week in same time as my SSN form. Am I a "Legal Alien Allowed to Work" without it?

Without an EAD and SSN, you are a "Legal alien not allowed to work". Note that, as a woman, and since you have already got married, if you are taking your husband's surname, you will not be able to apply for an SSN until you get your EAD card. Until you have both cards (EAD and SSN), you cannot work.

Yup, otherwise you wouldn't be able to get a temp work authorisation stamp at POE (although JFK is the only one known to do this regularly).

The temporary stamp that is issued at JFK is a 90-day EAD. Since the OP has no EAD and SSN, she cannot work, period. Therefore she is NOT a "Legal Alien Allowed to Work".

The OP is applying for a SSN, it's kind of difficult to apply for a SSN if you need to have a SSN in order to apply. ;)

According to mdyoung, who is pretty much the expert on all things SS related, you tick the allowed to work box.

To add my 2 cents, check the "legal alien allowed to work" box. I just went through the same thing. The card will say "allowed to work only with DHS approval" or something like that.

Under K1 you are a legal alien authorized to work. They will not issue the card if the I94 is within 2 weeks of expiring. They also wont recognize the married name without authorization from USCIS. They prefer the EAD or green card for this. I think they are supposed to change your name in the computer to the married name with the NOA from adjustment but they will not give you a card.

Whenever you go in the office get printouts of everything they will give you. These printouts will help them greatly through this process. If you happen to get a number you can use it to open bank accounts and such. You don't really have to have the card and once you are given a number it never changes.

PS:

Be very patient with them. The guard carries a gun!!!
