Hey guys I really need you're help. Here is my situation, My wife and I got married (K1) in November, filed all the necessary paperwork including the AOS and EAD. A few questions:

1) The 90 days is almost up for the EAD. What can we do to get one if 90 days passes?

2) I (U.S. citizen) need to file my taxes, how should I file because my wife can’t get her Social Security Card until she gets her EAD? Do I file single? Married?

3) She has her AOS Interview April 30th, we need to show proof our marriage is real. Now we have all the photographs of the wedding, I'm her beneficiary on her life insurance, and a cell phone contract. That’s about it. Without a SSN, I can’t add her to my bank account, credit cards, beneficiary, or insurance. We live with my parents right now so we don’t have any type of lease or anything. What the heck can I do?

4) As for bank statements, will they look to see how much money is in our account? Does the amount make a difference?

4) Could we get approved/denied that day? If denied, does she have to leave the country immediately?

Thanks in advance for your help. I feel sick to my stomach everyday thinking she might be taken away from me because of stupid paperwork. This is such a stressful process and I thought the hard part was over, but its really only beginning.

1. Has she had her biometrics appointment?

2. You have to file as married, married filing jointly (including her home country income) or married filing separately. For her ID you need to get her an ITIN.

3. My bank let me add my husband with his passport, so you should check with them. My health insurance company didn't require any ID for him, so you should check. Have your parents write a letter stating you live with them.

yes she had her biometrics done.

I read online that she could get her SSN upon arrival, yet our SS Office told her she coudln't get on until she got her EAD?

no we did 3 weeks before it was going to expire. i just have idiots working at my office. it's the jersey city SS office so I expect trash, lol.

There are several getting approved at their interview so you should be OK. You probably should call customer service about the EAD though if it's been 90 days since the biometrics.

There are several getting approved at their interview so you should be OK. You probably should call customer service about the EAD though if it's been 90 days since the biometrics.

When did you guys get married?

no no I live in jersey, lol. I just had a bad experience when I went to JC. we got married in November. 90 days is up in the first week of march.

90 days is only a guideline for EAD. It could be more or less time. Look at the timelines to see how long it is taking on average. I think it is a little over 90 days.

Proof of marriage - you should have a marriage license! Proving ongoing marriage, once she has EAD and thus SSN, she can be added to bank accounts etc. If the interview is end of April then there should be enough time to get this done - another 2 months still. Also she can usually be added to health insurance policy without a problem. My husband has me as the beneficiary for his life insurance plus I have been added to health insurance, neither of which required me to have SSN just passport.

Maybe even envelopes showing recent mail arriving to her in her married name at your address might be enough to show you are still married and living together... Recent photos etc...

I believe if denied that she would have a month or so to leave the country.

i'm sure things will go okay. Keep your chin up :-)

1. Nothing. You will likely get your green card first. We did. If she has no social security number, she isn't working and you don't need an EAD

2. A K-1 visa holder is eleigible for a SSN the moment the step off the plane. Go the SS office Monday and get her card. If she has changed her name after marriage, use her maiden name (same as in passport) so you avoid the many weels delay while SS sorts out the name problem. After you get the card (and file your taxes) go back and change her name. If you file taxes electreonically you will have to wait 2 weeks after she applies for the card for thr IRS computers to catch up with the SS computers or your e-filed taxes will be rejected. My wife, K-1, got her SSN the day after she arrived. We added her to our bank account the Tuesday after she arrived. When you apply for the SSN, she can go back to the office the next day and find out what her number will be, then go to the bank and add her to the account. It will take a week to get the SS card, but once you have the number you can do all you need to.

3. You're fine. Add her to your bank account as soon as you get the SSN. By the end of April you will have one or two statements to show if they even ask. We didn't have to show any "evidence" at our interview even though I was holding the whole box full on my lap

4. No. And no.

5. Yes, you will be approved or told what else you need that day. Even if she was denied she would have 30 days to leave. You have nothing to worry about. Nothing you said here would indicate any problem. Get the SSN and add her to the bank account

The requirment under the law is that you are married and the marriage is legitmate. There are tons of legitimate marriages where the couple has separate bank accounts. It is not required to share a bank account, insurance or anything (except maybe the same address, even if it is your parent's basement) but all these things help to establish that.

You have much more ability than you think right now. One is the SSN, she is definitely eligilble for that. My wife had both a driving learners permit and then her driver's lisence before the green card. We did have to show the I-797C (noa1 from AOS) to get the drivers license. We chose to put her cell phone in her name only and signed up for satellite TV in her name only for the purpose of establishing her own credit. The cars are in both our names, title and registration, and she is beneficiary of my insurance policies. If you have health insurance and signed her up for that, take a copy of the enrollment form. At any rate, I had tons of information at our interview and never needed it. My home mortgage is still only in my name.

PS: My wife did not change her name and does not plan to....no problem. You do not need anything in her "married name" We also took letters sent here, addressed to both of us from the scholl where our son attends and also took copies of the schools enrollment records listing us as parents. Like I said, we never needed it, but what the heck! When she volunteered at the interview tha she had an SSN and driver's license they did take copies of them, but they never asked for that until she mentioned it.
