hi everyone,

my wife left me (usc wife) , i did apply for us citizenship based on 3 years, got to interview and passed the test, after a week from my interview my wife left me and we are now separated not legaly, she got her apartement...i still live in the same appartement .

my question is i got my oath letter: and the letter has a question about if you still maried or separated or divorced after your interview.

like i said we are not legaly separated. and i dont know what to doat the oath, do i got denied for citizenship if i did say yes we are separated, or do i need to fill NO to that question since we are not legaly separated.

we are still trying to work on our marriage.

please help i got confused , i tried to look online but nothing like my situation

If there is no written and signed separation agreement, then your marital status has not changed even though you may not live together right now. Couples go through periods of anxiety like this, and I am glad you are working on the marriage. Marriage is a blessing and it's also hard work. But right now it is between the two of you, and not the government's business.

it's a shame that a simple question like this could not be answered on the USCIS website. a simple definition of what "separated" means in a legal sense as it applies to immigration would do. but no, we can't get that.

as long as nobody has filed divorce, or some other separative action, you are just in the midst of a bit of marital discord. sure, it looks like you will divorce, but you aren't separated yet.

congratulations on your impending citizenship. take it seriously, and we will take you seriously.

Actually that would be difficult for any agency to do. The legal definition of "separation" falls under state jurisdiction, not federal.

If there is no written and signed separation agreement, then your marital status has not changed even though you may not live together right now. Couples go through periods of anxiety like this, and I am glad you are working on the marriage. Marriage is a blessing and it's also hard work.
