Hello and Greetings Everyone,

My wife is going back to the Philippines and she has been waiting a very long time (Since October 2007) for her Adjustment of Status to be approved from the Dallas USCIS office. We have a couple of questions:

1. Can we contact our Senator or Representative about this issue and ask them for help? Do you think they will help us and has anyone had any success with this route?

2. She will be traveling to the Philippines this year and she will be filling out an I-131. On this form does she fill her name in as it appears on her Philippine passport or does she use her current Married Name?

3. Our 6 month old son will be going to the Philippines with her - does he need a passport as well?

4. Her passport is expiring this May. We looked on the Philippine Embassy website and there seems to be a few things that need to be done. We think that we need to fill out a Report of Marriage, a Passport Renewal application, and an Amendment of Passport apllication. But we also see that we may only need to do Report of Marriage and a Passport Renewal application. Does she use her Married name for the new passport? Has anyone done this?

5. Is there anyone else in this situation where their AOS is taking longer that 1 year?!?

05-02-07: Visa received and in our hands!! Seeing is believing!! :):):D!

We did the info pass and we went to USCIS today, but they did not give us any new information, they only told us to file for another working permit and advance parole which sucks since we need to pay another $305 for her to travel and $345 for her to be able to work. We paid this already with our application before and now they are asking for another fee. It's not our fault why they are too slow approving applications, and its frustrating to everybody paying another fee's, since we have paid it already. Can't they just renew the travel document and working permit and not pay again?!!!

I took Claudeth to the Filipino consulate in L.A. and it was a wild ride getting her passport renewed with her married name. Just make sure you take all your documentation with you including your marriage certificate and any certified divorce papers if the USC was previously married. I had to keep going to the copy place and getting more copies done. The Filipinos certainly know at thing or two about red tape. :P
