I keep reading that an overstay will be forgiven on the visa waiver program as long as the person is married to an "immediate relative" such as a United States citizen....is this true? Also Id like to thank everyone for helping out on my previous subject of not being able to afford the AOS fees right now. Im really trying to save,but if I run a little over the time frame when her I94 runs out,just need to know if immigration would forgive it?

As replied in your other thread. Yes an overstay will be forgiven at the AOS interview. Your problem come in the time between the I-94 expiring and you applying for AOS, if your spouse was stopped and her immigration status questioned you could be in trouble as she will be out of status and could be detained and have to appear in front of an immigration judge and could be deported. This has happened to other. Remember anyone entering on a VWP has given up their right to appeal if they are found deportable.

File as soon as you can and if needed borrow the money from family or friends.

Say Fellow, are you sure your just not being just alittle LAZY?! Uncle Sam kept up his end of the bargin, now YOU need to keep up YOUR end of the bargin. PAY UP, and you'll feel better.
