Removing of Conditions in process and Citizenship

Hello,

I filed I-795 Removing of Conditions in August 2008 and I got my first NOA on September 2008. I also had my biometrics done and now I am waiting for the GC. My case is at the Vermont Center so..... if they are procesing files from March that means I have to wait at least another 5-6 months if I am lucky.

I am thinking of appling for naturalization but I do not know if it has to be 3 years from the date of marriage (which i June) or 3 years from the date of my first GC (which is October)?

You can apply for citizenship 3 years after you became a permanent resident (October).

It is NOT 3 years from the date of marriage... it is 3 years from the date of receiving PR status.

This is the right answer. Three years from PR status which is the date on your GC.

Actually, it's both. And one more. You must meet ALL THREE of the following criteria to be eligible for naturalization based on marriage to a US Citizen

* Three years of continuous residence after attaining LPR status (green card).

* Three full years married to and living in valid marital union with a USC Spouse.

* Spouse must have been a US Citizen for a full three years.

You can meet these in any order. But you can't become a citizen until all three are met. So whichever one is met LAST determines your earliest possible filing date.

You can file your paperwork 90 days before meeting the "three years continuous residence (green card)" requirement, but you still must meet the other two requirements, with no 90 day shortcut, on the day you file. And before you actually become a citizen, you'll have to meet the continuous residence requirement for the full three years.

A lot of people meet the requirements in reverse order: That would be the case if your spouse was a USC since birth, and if you got your green card after you were married to and living with your USC spouse. But you can conjure up circumstances where the requirements could have been met in any order. For example, someone who got a (non-marriage-based) green card a bit before marriage might be able to send off the paperwork on the third wedding anniversary.

Note that, for naturalization purposes, a conditional green card is just as good as a permanent one. So you don't have to wait three years after removing conditions -- it's normally three years after getting that first card, which might be about a year after you send off the I-751.
