K1 Confused Newbie

Hello VJ I’m a newbie that is filing for a K1 visa my Fiancé is in Jamaica, any who I just started the paperwork but i am confused on a couple of things and I wanted to know if you guys can help me?

1. With the g-325 form the area where you write how you and your fiancé met, do you have to write two different perceptions one for your g-325 and one for his or can you use the same one for both?

2. Is there a certain amount of money you have to make to be able to file for your fiancé? And is there a certain amount of money you have to have in your 401k or bank accounts?

3. I’m confused on my service center and the place you sent the I-129 is this the same place I looked up my service center and mines stated Jacob Javits Federal Building 26 Federal Plaza, 3rd Floor, Room 3-310 New York, NY 10278. But I often read something about a Nebraska office on this site?

4. Is color pics really important? (i have alot of pics and this seems kind of costly)

5. in my I-129 question 18 letter I wrote on Valentines Day we mutually agreed that we did not want to be separated anymore and wanted to get married and live the rest of our life’s together no matter what sacrifices we had to make, I did not say he got one knee and proposed to me, should I change my original statement to reflect this I ask because we do not have a ring yet and honestly that’s not how it happened but it is a FIANCE visa?

6. On the g-325 his work history is self employment he has a farm, he designs t shirts and do music locally is this okay?

7. the FEES omg i was looking and a guideline from 2006 and I’m thinking the fees are still the same so I’m still trying to get over the $170.00 to $455.00 jump just to file the I-129 so my question is where can I find the fees for him I know there’s a fee for the police report from Kingston, to set up a interview and such I’m guessing if the fees changed for the I129 it probably changed for the other documents

4/10/09 - VSC received packet

4/13/09- VSC opened package

4/15/09- VSC mailed NOA1

4/17/09- VSC cashed check

4/17/09-NOA1 online

4/20/09-NOA1 hard copy

4/20/09-Touched

4/20/09- now we wait...

8/27/09- touched

8/31/09- approved!!

9/4/09- letter saying they mailed info to kingston

11/16/09 sent DS230 via email

11/18/09 rec email stating interview was scheduled for Dec

11/19/09 sent email asking what day in Dec and they responded Dec 8th!!!!! 2WEEKS

11/20/09 rescheduled to Dec 22 my preference date

12/22/09 Went to JA 12/9 and di ting is postponed until mi kno it's right!!! mi nah rush into nothing mi rather wait forever and kno everyting proper and sort out then rush and bawl lata... Mi kno when mi ting ah happen it ah happen RIGHT suh fah now mi ah wait likkle more...

2. Is there a certain amount of money you have to make to be able to file for your fiancé? And is there a certain amount of money you have to have in your 401k or bank accounts? To petition for your fiance, you don't need to show income. For the Visa interview however you must meet 125% of the 2009 Federal Poverty Guidelines for your household size - Google "2009 Federal Poverty Guidelines" to find out how much that is.

3. Check the instructions pages of the I-129f - there are only two service centers that process K1's and they are California and/or Vermont [/color]

I wouldn't change anything because you didn't get down on one knee - this is not a requirement.

Thanks everyone i pretty much got all my paper wrk together all im waiting for is to fill out him mom bday info on his G-325 and wait for his passport pics to come in the mail,(i have a very neat and organized package just waiting to be shipped off) i have looked through all the introductions and forms to print, this website is truly a blessing for anyone going through this situation, i checked the guidelines for income and the proverty guideline for 1 person is 10,830 and i make 30,993.44 so im assuming im okay by the guidline even though between the trips back and forth and these fees im overwhelmed lol... lastly you dont need a certain amount of money in your bank account?

Some people have their checks cashed right away and some wait longer... hard to say. ;)

Unless you are using assets to cover the level of income needed, you do not need any money in the bank for this process (other than the money needed to cover drafts to them!)

Yes, they usually cash the check within 1-3 days of receipt. usually.

Be sure to have sufficient funds to cover the draft in your account.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

oh do they cash your check as soon as they get it???Pretty much so - it is processed electronically.

Keep in mind, for a couple (no children), the household will be at least 2 (fiancé and USC) and the needed amount is 125% of the Fed. Guideline amount. You're still more than OK, just an FYI.

As stated - unless you're going to use your bank account as an asset (and from the sounds of it, you do not need to) - you do not need to list your account and/or it's contents (so no, you do not need to have a 'certain' amount). :thumbs:

This can be a daunting process.

With the questions you're asking, I'd take a step back and make sure you study the guides here, then study the instructions that come with the forms and the forms themselves. How could you possibly be ready fo file during the same hour you asked all those questions? The first one was totally irrelevant. You would know that by looking at the G325a yourself.

Usually true... BUT.... It's important to note that we sometimes have folks who have waited weeks for their checks to cash.... no rhyme or reason... but much stress for those expecting it to cash within a day or two. ;)

Has your fiance signed his G-325? Just that it sounded like you were completing it all on his behalf and he does need to sign all 4 sheets.

No, he needs to sign them. YOu can send it in and hope, but most likely they'd send you an RFE. Its up to you if you'd rather wait now to make sure its all in order or wait in a few months because of an RFE.
