Have you been living your lives as a married (to each other) couple? You will have to prove that the marriage is bonafide. You should read through the guides for the I-130.

Yes... I'm reading it... but you know sometime we get confuse with it.. I'm afraid go to imigrattion office in my country and they don't give me any visa to go back....and do not say anything about it in the form... thanks anyway....

Clarki,

If you are still in a bona fide ongoing marital relationship, your spouse can file an I-130 petition and get it approved. That will allow you to apply for an IR1 visa to immigrate to the USA. A key requirement for getting your visa application approved and visa granted is that you show evidence you remain not just married in name, or legally, but that you are living a bona fide relationship. For instance, if you haven't seen your wife for five years and characterize your relationship as "still good friends" and "She'll make it easy for me." That's not going to work.

Whether such a visa is issued is not a mere techicality with regard to the marriage. It has to be shown to be a genuine currently ongoing marital relationship. So, when is the last time you saw your wife?

Better question would be... Are you sure you're still married to your wife? Being good friends w/ the wife is one thing, but unless you maintain very close contact (which should have included several personal visits within the last five years), whats to say that the wife hasn't sought a divorce in absentia and is no longer married to you, Dr. Clarki?

P.S. Dunno why, but I smell troll

Hi.. I got married on august 2003 and we stay together till oct 2004 when I left of usa to finish MedSchool... we had apply for a residence.. I have my social security number and my process to a I465 was denial..( I wasn't there when they call for a interview - too bad) I'm abroad about 4 years... I will finish med school end of this year...(we are still married ).. she's caucasian ... do I had any chances to come back to usa after I finish medschool or I cant go back... ? ( By a come back will be about 5 years abroad)... ? any answers will be good for me... I scared of go back and be deported at the airport... thanks everyone...

u'll have to re-file the I-130 petition

Even I'm abroad all this time... (will be about 5 years) you think I can re-file the I-130.. will work? thank u very much.. make my day happy now...

Yeah you should refile, by you being in that country your processing time might run a lot quicker by going the direct consular route rather than waiting to return to the U.S. to file. Good luck to you!
