GOT NOA2 for I130 now visit hubby?

Hy guys,

I just wanted to know if it is possible to visit my husband now in the US after I got my NOA2 for the I130. We are going for the immigration visa. I visited him once on the VWP in February till May. What do you think? Would they still deny entry although I have my I 130 NOA2?

May 2006..Medical in Frankfurt

06/14/06...I-130 approved via email [day 111]

06/19/06...NOA2....I-130 received via mail

07/10/06...talked to embassy to expedite the process

07/12/06...NVC stated case completed and sent to FRANKFURT[day 147]

07/17/06...received packet 3 from embassy

07/29/06...received packet 4

08/15/06...INTERVIEW at 7:30am- APPROVED

08/21/06...VISA received

08/23/06...Flight to US

08/23/06...I am back home

09/20/06...received greencard in mail

09/27/06...received SSC in Mail

09/23/07...our daughter was born :)

30/05/07...filed for Removal of Conditions

07/05/08...received NOA for I-751

01/07/08...college here I come :)

waiting for biometrics and Approval.....

The only problem I dont have ties to my homecountry anymore....since I have cancelled my flat and all that. But since it is approved, why should I stay illegally in the US? Or am I not allowed to travel to the US anymore until I get my visa?

I doubt you'll be permitted entry if you have no job or flat in your homecountry. :no: Even if it is juts for a visit. :( Employment is a biggie if you are going for a Visa of any kind. They don't want you to immigrate illegally, and it looks that way when you have no ties from home.

if you dont try you will never know, I was once asked how my marriage worked with hubby being in the US & me in the UK, i said we were going through the immigration process & the POE officer asked did i have any papers with me for this, i did i had NOA1 he looked at it and everything was fine :thumbs:

I wasnt asked anything about job etc, just as well as i didnt have 1 at that time either!!........but when asked buisness or pleasure i said holiday!, family or friends, i said family, he said oh, who, i said my husband, thats when he asked how it worked :lol: , he was realy nice!!...........i even asked him if he wanted to see my return ticket, he said .NO your good to go :thumbs:

April/04/2005- Visa journey began!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

hm,

well the thing is am I still ALLOWED? I mean I do know as soon as your K3 is approved you are not allowed to enter the USA on the VWP. So how is it with the I130?

Yes Bella, you are allowed, but there is never any guarantees. That goes for whether you have a petition approved or not. Anyone entering the US is looked on as an intending immigrant. You may get asked to show ties, or you may not. Many have entered to visit their fiance/spouse successfully even with a petition approved and/or with the VWP. Take all your paperwork with you. If asked 'business or pleasure', one would answer pleasure. As with anything, dont give more of an answer than what is asked. The one issue that I can see is that you have only just been there from Feb till May and they will most likely query a return visit so soon.

You got your first NOA for your I-130 on 2/28/05 when did you send it if you can recall? The VSC website states they are processing I-130 Dec 24th it was the 17th a few weeks ago. You recently got approved which kinda states the VSC is processing a lot further along than they are posting.....

Hi there I send it in February 16th 2006 not 2005. Yes a few other people with a receipt date around February got approved (I130) as well. So they are ahead of time or maybe we just got lucky I dont know. But I do believe that USCIS is working hard...at least Vermont.
