hi guys, im new to the forum and can really use some help. i know that its really tough to be separated from the one you love. heres my situation:

i married my wife back in vietnam in november 2008. i came back to the us and finally mailed out the package last week. i mailed out a I-130 form, 2 G-325A form (mine+hers) to the chicago po box. now i guess im just waiting for the receipt notice?

Now my question is, what visa does this fall under? the k3 or the cr-1? i notice some people is filling out both the I-130 and the I-129F? what is all that about? can someone please explain to me? any comments would really help...im a newbie to this stuff. thanks in advance

I-130 will get her a CR-1 visa. It's a MUCH better visa than a K3. After you get the receipt notice for the I-130 you can file the I-129F for the K3. They are COMPLETELY different visas. GO for the CR-1. Cheaper easier and a LOT less hassel when your wife gets to the US. K3 is a NON immigrant visa and CR-1 is a immigrant visa.

hi, thanks for the response. i just went through the forum, kinda have a better idea of it now. i just checked the processing time for the i-130, it says 6 monthes on the uscis. isnt that around the same time frame for a k3?

Normally takes about a month longer than the K3. WORTH the wait by a LONG ways tho. I didn't wait and BLEW it going with the K3

Having co sponsors depends on the COs at the embassy's. Not sure about Vietnam.

It's a TOUGH embassy tho!

Check out recent timelines . Ours was a long time ago. Also surf CR-1 section and K3

I am working on CR1, it's much better, just look at my timeline. USCIS for us only 5 1/2 months, and I am working on NVC. I think should take less than 2 months.

I am totally confused as well since both K 3 and I 130 are getting approved together whereas it used to be that the K3 got approved faster and then I 130 was approved a few months later. When this happened, the consulate processed the K3 visa and the beneficiary wasn't able to enter the US on a CR1 visa and had to adjust status after arrival.

HOWEVER, now that I 130 is being approved on the same date, where does that leave us I129F/I130 filers??

Many people have said they would he be able to wait after receiving the K3 interview and try to swap it for the CR 1 interview. But, will awaiting the CR 1 interview further delay our wait by a few months or a mere week or two?

I don't even know if I am making any sense :wacko: . This whole thing of both being approved at the same time is new to me. I am not sure whether I should be glad for it. Does the interview/visa approval for CR1 entails more wait and more extensive background checks/delays such as AP than the K3 would? :unsure:

Yeah unfortunately we were one of the "I wish we hadn't filed the K3". I've yet to see someone post I wish I'd gone with the K3 instead of the CR-1/IR-1 !!!

I am totally confused as well since both K 3 and I 130 are getting approved together whereas it used to be that the K3 got approved faster and then I 130 was approved a few months later. When this happened, the consulate processed the K3 visa and the beneficiary wasn't able to enter the US on a CR1 visa and had to adjust status after arrival.

HOWEVER, now that I 130 is being approved on the same date, where does that leave us I129F/I130 filers??

Many people have said they would he be able to wait after receiving the K3 interview and try to swap it for the CR 1 interview. But, will awaiting the CR 1 interview further delay our wait by a few months or a mere week or two?

I don't even know if I am making any sense :wacko: . This whole thing of both being approved at the same time is new to me. I am not sure whether I should be glad for it. Does the interview/visa approval for CR1 entails more wait and more extensive background checks/delays such as AP than the K3 would? :unsure:

K3 is virtually a dead issue for the vast majority of couples and has been since November 16, 2006. The news is slow to spread, unfortunately.

Do a search on "If you want an immigrant visa, don't file an I-129F for spouse" and see how many hits you get. And that's just me.

In general, no. In a specific case, maybe. That would be unpredictable.
