I'm getting ready to file at the Manila embassy so my wife and I can move to the US. My wife has a son but we are not filing for him yet, just for my wife. There is an issue with the way my wife's name is listed on his birth certificate. In order for her son to go to the US we need to go to the Filipino authorities and have his birth certificate corrected in order for him to get a visa.

My question is, on the application for my wife it asks for her children's names. Does anyone know if we will need to file a copy of her sons birth certificate in order to apply for my wife's visa? We're trying to figure out if we need to fix his birth certificate in order for my wife to get a visa or if we just need to fix it in time for him to apply for a visa.

Any help is appreciated.

I take ityou are doing a DCF?

Better to do both at one time no matter what visa you are going for.

Can't you just get a affidavid of discrepancy from NSO for the kids BC?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

They are interested only in the docs pertaining to the applicant, not his/her relatives. They won't ask for the children's BCs.

You should refer to the VisaJourney Guides to the visa types to see what docs are required. You won't even need to submit a BC of you wife herself until later at the NVC stage.

You can do a DCF if you have a legal resident status in the Philippines or have been there for a year at least, as far as I know.

You do not need the son's BC for now but it is advisable to fix your wife's name on her son's BC as soon as possible - so she wont have problems when she files i-130 for her son.
