Co-sponsor and affidavit of support

Hi All,

We're confused with the whole affidavit of support issue and after reading the guides and searching for similar topics, still having no luck. We are in the process of the K1 visa and awaiting our NOA2. My fiance (the petitioner) was making above poverty level for the last three years however was laid off recently. He JUST found a new job but he wont be receiving a steady income until he gets all the necessary licenses required for his job. I am aware that he will still need to fill in an affidavit of support however, for Q7: "I am employed as or engaged in the business of ____ with ___ ...I derive an annual income of ____" will he leave this blank even though he HAD a job and had an income?

My understanding is that he will need a co-sponsor and was wondering if:

- the co-sponsor will need to complete the same I-134 in addition to the petitioner's?

- the co-sponsor will be his mother, who has filed joint taxes with his step father and have a young daughter. The mother earns less than the step father but will meet the poverty level for 3 or 4 people (will need to double check this). Will the mother (co-sponsor) need to list everyone in her household (stepfather, daughter, petitioner) as her dependents on Q8: "The following persons are dependent upon me for support" even though the step father is not dependent on the wife and the petitioner is partially dependent? Im aware that for the daughter, she will check "partially dependent".

Sorry to sound so complicated here but its just that the co-sponsor always files joint taxes with her husband and was unsure of how they would fill in the affidavit of Support.

05.15.2012 -- NOA1 dated 05.15.2012

05.31.2012 -- Biometric notice date

06.27.2012 -- Biometrics Taken

01.23.2013 -- Card Production Ordered.

01.28.2013 -- 10 Year Green Card Received

He can put whatever his current income actually is. If zero, write zero.

Co-sponsor provides I-134 and supporting documents, claiming their own personal income only, even if taxes are file jointly. In these cases, use tax return copies along with all supporting documents like W2 and/or 1099 forms.

She would NOT list the US Citizen petitioner unless he is actually her dependent. I doubt he is. Citizens don't need sponsors.

Facts are cheap...knowing how to use them is precious...
