I-864 question-Plsss.Helpp!

Hello People of VJ,

Am still on the process of filling up the I -130 Petition to get my kids from the Philippines. Am confused on the ff. questions:My hubby being theUSC will be the petitioner for my two minor kids.

Affidavit of Support Form: Here are my questions:

Part 2

9.I am sponsoring the following family members immigrating at the same time ...Do not include any relative listed on a separate visa petition.

[/color]Should I include my other child since it says do not include any relative listend on a separate visa petition?

Should i put my 2nd child's name on the box below that says:

name/ relationship to sponsored immigrant/

Or no since it says do not include....

Part 3

10. Enter the total of immigrants you are sponsoring on this form from part 3, items 8 & 9

Should I count my 2nd child?and count as 2 immigrants?

Part 5

Persons not sponsored in this affidavit:

c. Should I count myself as 1? my hubby is married to me.

d. If you have dependet children enter the number here?

Should I count my hubby's daughter that he is sending child support but not on his income tax as his dependent? Is his daughter considered his dependent or just the son born on our marriage?

e. If you have any other dependents ,Who are the dependents asked in this question? My hubby is supporting my 2 kids in the Philippines..are my kids considered his dependents on this part?

In short my hubby has 5 dependents;;am i right?

- Me being his wife =======1

- Our 7 month old baby + 1

- my 2 kids in the Philippines=2

_ he is giving child support to his 14 yr. old daughter but not on his income tax,should i count that too?

Also I will need the form I-864 for the I-130 petition..and not the I-134,am i right

Plsss..i really need your help as i can not find a sample form that involve kids.

I reall y would appreciate your help .

Hi Charles, just curious why of Permanent resident when I am not the one petitioning my kids,..it;s my husband as USC petitioning his step children?

Anyway..plsss help me guys..thanks so much in advance.

I believe each child will get their own I-864 so you will only enter each child's info in item #9. Same goes for item #10. But wait until other people come on here to try to help you out.

In Part 5 your husband needs to include everybody, your children (21.a), himself (21.B), you as his wife (21.c) and his daughter (21.d) if he claims her as his dependent.

One last thing, since you're filing form I-130, you won't have to send form I-864 until the petition is approved by the USCIS and is sent to the NVC. This can take a while so you will have plenty of time to gather everything for them.

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
