Hello all. Im glad I found Visa Journey to help me with immigration questions. Comforting to know Im ot the only one who needs a helpig hand. Anyway,my problem is this. My wife came here on the visa waiver program. She has been here (before marriage) a few times. This last time here I decided to ask her to marry me and so we tied the knot. Her 90 days will be up in a few weeks,and the problem being is we wont have the money to send in for AOS for a few months.

Getting married spur of the moment,didn't really think about this,didn't realize the cost. I am above the poverty line,but with bills,this economy...etc...havent been able to put much $$ away. Will we be able to adjust status a few months down the road with no problems? I have read where overstay is forgiven when married to a u.s citizen. I can eventually pay for everything...just not right now and am worried about her overstay and AOS....would appreciate everyones help!!

While you ought to be able to adjust without much issue down the road.... just remember that when the I-94 expires, without the benefit of a pending application to the USCIS, the alien is subject to deportation if discovered... this is regardless of a marriage to a USC or not.

You need to find a way of getting that money and filing before her I-94 expires. Borrow from family if you have too, take out a loan, do whatever you need to to be able to file.

If you dont file before the I-94 expires she will be here illegaly and she could have major issues if she is stopped for any reason. She could be detained and taken to court and deported.

the other choice is that she departs the US before the I-94 expires and you file for a CR-1 visa and she waits back in her home country for the processing to be done.

File as soon as possible preferabably before the I-94 expires. But if the choice is between feeding your family and providing basic necessitities provide for your family first. Whatever you do DONOT let her leave the country under any circumstances.

You are not alone, many find themselves in in a similar situation in this economy. Good luck

please update ur timeline. what visa did ur wife came on. what is a visa waver program? Overstay is forgiven when married to a USC but I do not know about visa waver program. Below is my personal question and answer from an immigration lawyer:

Q. I came into the US with a B1/B2 visa and received treatment for cancer. During that time I met a US citizen and we got married. My visa had expired 4 months before we got married and now we are preparing to petition. It is almost two years since we got married but we were not able to file as my husband became sick with cancer and all concern was to get him through the down days. Will the expired visa affect my application? I last entry to the US was June 2005

A: As long as you legally entered the United States, which you did on your B-1/B-2 visa, you are eligible to adjust status by marriage to a US citizen even though you are now actually out of status. I have successfully done many green card applications for clients in this situation.

Normally, to adjust status and get a green card, one must be in a lawful immigration status. A big exception to this rule exists for "immediate relatives" -- the spouse, parent or unmarried minor child of a US citizen. As you are the spouse of a US citizen, you are an immediate relative and will be able to adjust status even though you are now out of status. Immediate relatives are also able to adjust even if they have engaged in authorized employment.

I would try to do it as soon as possible. The beneficiary has no ability to do anything without getting status changed.

Entering the United States under the Visa Waiver Program (VWP) – What happens at the port of entry?

Detailed information about admissions and entry to the United States under the Visa Waiver Program can be found on the DHS Customs Border Protection website at Visa Waiver Program and Admission to the United States. Since September 30, 2004 VWP travelers have been enrolled in the DHS US-VISIT program when they arrive at U.S. ports of entry. Travelers should be aware that by requesting admission under the Visa Waiver Program, they are generally waiving their right to review or appeal a CBP officer’s decision as to their application for admission at the port of entry. Likewise, if the traveler is later found to have violated the conditions of admission under the Visa Waiver Program, they do not have the right to contest a removal order (See CBP website for additional details.)
