Sorry if we're off-topic but someone else might be also in the same situation.

Brit, on second thought, I think that the church wedding should have also been mentioned in the Annulment Decision so that the civil aspect of that marriage could have also been annulled.

I know one friend who was married only in church but she filed annulment for both civil and church. Which means that even if she married only in church, she had to do the civil aspect of it in court to make her eligible in civil law to marry again.

All these is too technical for my simple mind so maybe you need to ask your sister's lawyer about her situation.

As an aside, since your sister's annulment is fairly recent. If she finds out that a MC for church is existing, she can have the court decision amended to include the church wedding so that she doesn't have to file another petition.

Look what you started Uling, you opened a can of worms!!!:D:P

Hi again!

yup off topic but i'm butting in :P

I had a church wedding, Catholic rites only! no ciivl rites... and I got an annullment in court... only way i can be legally free to marry again. My lawyer and the Clerk of Court never told me to get a church annullment in order to be free to get married again.. so can safely conclude that the court decree covers it all right.

Thanks PW...yup, can't wait to be in this list!

My sister now is asking me why suddenly I'm getting interested with her annulment case and she's saying that I'm just going to get married and I'm already analyzing those things  .

oh and Brit, since you got it all cleared already.. back to the list now

Uling... my guess is your fiance didn't have to go through the annullment process that's why you are not knowledgeable about it... you are so lucky! My fiance is an expert at it after three gruelling years of annullment hearing postponements .. an expert at what reasons for postponement the court will give in the next hearing!

Taught us patience indeed..

now now back to the very important list ... really! :star:

Gen

Hello friends,

Allow me to share some thoughts on the annulment process.

After the annulment decree is handed down, I would advise you to secure a complete copy of the decision, have the court note that it is a certified true copy, secure a certificate of finality, then bring these two documents to the National Census and Statistics Office for annotation of the annulment into you marriage contract. Then bring this annotated marriage contract to the church to register the annulment and then go to the Local civil registrar and show these documents, then get another copy of the annulment certified by the Local civil Registrar. This is tedious but this is the way it should be done as the Manila Embassy will ask for the annotation of the annulment on the NCSO copy of the marraige contract.

My lawyers were very helpful in guiding me through the tedious process but it goes a long way for smooth paperwork.

Church annulment is another process. Marriage in church is considered as a civil AND church marriage.

Good luck.

I've received my visa yesterday.

Though, I just want to confirm/clarify something.

The visa package is wrapped in a clear plastic (inside are purposely cut brown envelope, some documents outside the brown envelope, instruction for CFO and my passport). There's an instruction that says I should not open the visa package because it will be opened upon entry in US and if not followed will cause some difficulty and delays. My understanding to this is I can open the plastic but not the brown envelope and one more thing the brown envelope was cut purposely, so that adds to my confusion bec there's also instruction that I should not open it.... Help! Please shed the clouds :)

I can't afford to make mistakes now so I'm asking folks out there who have been through this process.... :help:

Thanks DANOCO. I did call the embassy yesterday to clarify this and you're right it was really cut purposely to check if the documents inside match the passport number.

Thanks again..

I have bad news for you friends. Just as I finished the final process of my 2nd annulment yesterday, the embassy decided to deny my visa on account of my civil status. They have sent back my case file to the USCIS.

I sought valued opinions and concluded that filing another petition and starting all over again might be a better option than having to file an appeal which could take months with uncertain results.

I have removed my name from the list. So Uling, do you want to take over? I think me and my fiance will be busy in the next few weeks preparing documents for the new I-129F.

16 months of waiting... and another 6-8 months loom in the horizion :clock::cry: Only consolation is that I won't get to spend a cold winter in MI this year  And time flies anyway so it should not be too much of a wait. Staying positive here

Thanks everyone for your support.

With the new IMBRA law, I'll have to re-learn the initial process all over again. I'll try to pop in here once in a while.

Good luck to all of you and the rest of your journey! I hope your journey is smooth and problem-free.

Don't worry about me, after the initial shock of the denial, I'm feeling a lot better now. It's all for the best. I'm still as happy as can be. We're not about ready to give up.
