it does sound like a trick question but i'm sure everyone has the intention to work if you answered PERMANENTLY on question #26 unless you're only going to the U.S. to marry your fiance(e) then head back home w/in 90days. it's gonna be a big financial burden on the petitioner and not to mention boring if you will just sit home and do nothing. i guess this question is open to interpretation. anymore thoughts on this?

On the morning of Aug. 29th I will be going to the US Embassy Manila to obtain my Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage. Fely and I will be going directly to the Embassy after my plane lands at 5:35 that morning. I know the American Citizen Services Branch is only open from 8 - 10 am, so I'm hoping to get there in time and not have any difficulties with the process. I was just wondering if anyone who has already obtained this document has any comments or suggestions that might help Are any documents asked for besides a passport? Is it hard to find the correct entrance to the Embassy? Excuse my questions, but I hate going into anything blind. Thanks.

There is a wide range of financial situations. It is quite possible to expect to remain permanently and not intend to work.

I wouldn't read so much into it. If you're concerned, for "are you going to study", say "Yes, after I marry my fiancee and we discuss it together" or something sappy like that. Do you really think they are going to believe that you are not going to study OR work?? I would tell the truth always but word it in a way to focus on the fact that your purpose for entering the US is to marry your fiancee.

My fiance and I are doing the K-1 process but you can check out this link from the US Embassy website regarding filing for the legal capacity to marry.

You will not have difficulty finding the US Embassy in Manila. If you are taking a cab, just ask the driver to take you to the US Embassy Manila at Roxas Boulevard. When you get off there are many security guards in the embassy who can direct you where to enter. Hope this helps and good luck on your trip to the Philippines.

I have read elsewhere that you should answer no to the questions about work and school in the U.S. because those might be reasons for the consular to think that you are trying to use the fiancee visa as a means to get to the U.S. The consular might think you should be applying for a work or student visa instead of a fiancee visa.

Anyone's thoughts?

Goodman - I also thought the same and I could have sworn that I also read that somewhere, which is why we answered no to both questions and NONE in the boxes. Don't they seem like trick questions because of the wording "Do you INTEND…" However the DS-156 is the Nonimmigrant Visa Application and I'm betting (have not research this yet... just my presumption) that all the nonimmigrant categories complete this form. Therefore those who are coming on work visas and for school more than likely complete this form. In my simple mind, the intent of the K1 is to marry and it should be left as such, which is why we are afforded the option of applying for an EAD. This is a good question for a skilled immigration lawyer.

Hmmm... Well, if they will think that we will just use our US citizen fiancé as a tool to go to US then that's where the EVIDENCE OF GENUINE ENGAGEMENT will come to the picture. For me, as long as your honest with your answer and can justify it very well I don’t think there will be a quandary with that. We are already in generation X, and most of us now wants to work and use our brains in a very prolific manner :) .

Like in my case, I answered "YES, no definite employer yet" but the consul didn't bother to ask me about it.

Just my two cents :P.

While K1 is a non-immigrant visa, this is processed by the Immigrant Visa Unit. Embassy is aware that fiances are "intending immigrants" who are entitled to work and study if they so wish. So answering "yes" if asked if there is intention to work or study is okay.

K & V VISAS

Fiancé(e) of a U.S. Citizen (K-1), child of K-1 (K-2), spouse of a U.S. Citizen (K-3), child of K-3 (K-4), spouse of legal permanent resident (V-1), child of legal permanent resident/child principal/L.I.F.E. Act (V-2), and derivative child of V-1 and V-2 (V-3) visas are nonimmigrant visas in classification . However, applications for such visas are processed and issued only at immigrant visa issuing posts, which cover the consular district, unless the post has been specifically authorized to process K visas.

The American Embassy – Nonimmigrant Visa Unit in Manila is NOT authorized to process or respond to inquiries on K and V visas. These visa applications are processed by the Immigrant Visa Unit.

Why is not planning to study or work so difficult to believe? If that is the case then answer accordingly.

I'm so jealous! (but happy for you) We are still waiting on NVC receipt...NOA2 was August 3rd, so I'm hoping they get it any day now. I didn't know about that 2-year travel restriction - is the AP hard to get? We really wanted to go to the PI after about a year to get re-married and visit family. As for the work and study, I think they are really looking for specific if you have them (for example, if you already know the school you are going to enroll in or place of business where you are going to work). I think it really only comes into play if there are weak areas in the package; in that case, it would help substantiate the validity of the marriage and intent. For us, we will check them both (work and study), but not list where because we don't know where or when at this point.

ty for the congrats. I asked the consul before i leave if iam approved even though she told me already "congratulations" then she said "yes ur approved, go back to ur sit and wait for ur number on board so u can go to another window to discuss the delivery of ur visa, then i saw her grab the pink stripped sticker with " APPROVED K" ( by the way there are two types of sticker in front of her the green stripped APPROVED IV and pink stripped APPROVED K ) some other consul wont tell u if ur approved like from my other friends consul who interviewed them, jst make sure u see if she/he will grab the approved K sticker or if u miss that out make sure to look at it on the releasing window, it will be placed on top of ur folder.
