first of all, GOODLUCK! for u in able to get he decree order already this week, and hopefully for the speed process of your visa.

sorry for late replies.. i missed read this post of urs... anyway about mdyoung reply's to me, he said paste and said the requirement's of my questions about application of naturalization instead of aos for my k2 son. the only thing i was not able to comply is the needs to be a permanent resident. As what Joseand Helen says too, helen's daughter i guess aged 9.. and jose says they said they need to wait 3 yrs for that.

Me & my husband now plans to do AOS by july, we need to have throughly research of this matter and this month of june is we're kinda busy for the total renovation of our house here to comply with the basic needs of my husband. My husband is a retired police officer, accident on duty. In one-way he knew alot of US laws, but he still want to search this throughly, also his twin-bro married filipina 12 yrs now, and all of the 3 brothers we're working in government.

To my husband confusion, he already adopted my minor son (he is 4 yrs old), for his idea ... being adopted is already secured a citizenship bcos even a divorce woudn't hindrance it for my son using his last name, since my husband is a USC by birth.

I tried to browse this morning about CCA (Children's Citizenship Act), i believe i need to apply for AOS for my son so we cud change his status ... but the things is .. my son is in my husband lastname now, but my son AOS file should be in my maiden name since thats the name appear in his K2 visa. And we enter US as emmigrant or immigrants already???

this is what ive got ...... can u pls help me out tto understand this matter THAT MY SON COULD AUTOMATICALLY ACQUIRE CITIZENSHIP AS ADOPTED SON??

BCOS MY UNDERSTANDING TO THIS ACT IS, my son could fall under to :

- "adoption finalized in the US" and

- "to the requirements is, DOES MY SON COULD FALL TO ENTER TO US AS IMMIGRANT ALREADY??"

The Child Citizenship Act, which became effective on February 27, 2001,amended the Immigration and Nationality Act (INA) to provide U.S. citizenship to certain foreign-born children-including adopted children-of U.S. citizens. Specifically, these children include:

• Orphans with a full and final adoption abroad or adoption finalized in the U.S.,

• Biological or legitimated children,

• Certain children born out of wedlock to a mother who naturalizes, and

• Adopted children meeting the two-year custody requirement.

This legislation represents a significant and important change in the nationality laws of the United States. The changes made by the CCA authorize the automatic acquisition of citizenship and permanently protect the adopted children of U.S. citizens from deportation.

In general, children who are younger than 18 years of age and have at least one parent who is a U.S. citizen whether by birth or naturalization will benefit from this new law. Under the CCA, qualifying children who immigrate to the United States with a U.S. citizen parent automatically acquire U.S. citizenship upon entry; children who live abroad acquire citizenship on approval of an application and the taking of the oath of allegiance.

Frequently Asked Questions about the CCA

1) Does my child qualify for automatic citizenship under the CCA?

Under CCA, your child will automatically acquire U.S. citizenship on the date that all of the following requirements are satisfied:

• At least one adoptive parent is a U.S. citizen,

• The child is under 18 years of age,

• If the child is adopted, a full and final adoption of the child, and

• The child is admitted to the United States as an immigrant

2) Do I have to apply to USCIS for my child's citizenship?

No. If your child satisfies the requirements listed above, he or she automatically acquires U.S. citizenship by operation of law on the day he or she is admitted to the United States as an immigrant. Your child’s citizenship status is no longer dependent on USCIS approving a naturalization application.

Hey, I returned last Saturday from my 2 months in the Philippines. I've been too sick to post until today, but "Felyng" better finally. And I have the news many of you have been waiting to hear.

I'm single. Yep, my notice of entry of dissolution has been here at my house since May 4th. Unfortunately the envelope it came in had no return address, so my daughter didn't realize what it was. Too bad. So I now need to find the money to go back and marry Fely. Ha, she tells me I will probably have to feed 500 people at the wedding celebration, because she's one of the favorites of the family and everyone in the barangay knows her.

Well that's all I wanted to say for now. I may post more later or create a new thread with things I learned or experienced on the trip, if anyone's interested. Also for those interested I posted a few pictures, which you can view by clicking the link right below in my signature. Yea! one step closer to getting Fely's visa.

how are you guys? , well ill be needing a little help form you since you already started your AOS application: :help:

My husband decided to start working on with my AOS and my son AOS application by next week, so we're trying to startup getting all the documents we need. I'm starting to fill-up forms and had a little questions:

(1) since im married ... for example ..

ROWENA (givenname) REBEL ( middlename) HEART ( maidenname) QUIXOTE (marriedname)

silly question but ... so ROWENA is my given name, which one is my middlename?? to put in form I-1485??

bcos before i used to put my mom's surname, and here in the US my husband using his 2ndname as his

middlename and not his mother's maiden name. should i write my mother's maiden name as my

middlename or my maidenname which is my father's surname since im married already or i should put it

blank more often???

my husband include me in his insurance and he make it blank on my middle name and put my son 2nd

name as his middlename.

(2) do i need to transfer my vaccine result to I-1693a or i could send the vaccine report as it is.

thanks so much when you had time to answer this silly question of mine, i just dont want to make mistake in filling-up forms.. and thanks in advance for i might have more silly questions to asked about AOS things... :crying:

Hi Rebel, to answer your question:

1.) Your middle name now is your last name before which is your last name on your birth certificate. Don't leave it blank.

In US, people aren't big of using their mother's maiden name as their middle name. That's a culture thing.

2.) You need to go to an accredited Civil Surgeon (click on the link). The doctor might give you a TD shot and he's the one who will fill-up the I-693A for you. This signed I-693A must be included in your whole packet.

Guys, we're sorry if we're talking about AOS here,... it's just we don't want to leave this thread :P
