New York People - if ur Philippine DL is valid you can basically drive here legally as long as license is in English which it is.....I dont knowif there is a time limit to how long u can drive with that license, maybe 3 months or so, will find out..... dont know if u wanna drive here...totally insane drivers!

Star, yes i'm sure. You said that notaries are ot allowed to notarize US documents...you may be correct, however in this case they are not notarizing US documents...they are notarizing (authenticating) philippine documents....philipine passport and other form of philippine picture id.

Robor, the passport is mentioned in the list as you can see in the below quote taken from the instructions..its mentions VISA in the list...that is the passport (cant have a visa without passport...:) ) Don't know who told you dfz was only place that could notarize these things but that is not correct....we had a notary from Jasmins work do it. The instructions and the irs people i talked to just say to have it notarized....thats all...as you can see below.

Just trying to save you guysa lot of hassle and money....color copy is only a few pesos and regular notary just brato...no need to pay more!!

Individual Taxpayer Identification Number (ITIN)

What documents are acceptable as proof of identity and foreign status?

IRS has streamlined the number of documents the agency will accept as proof of identity to obtain an ITIN. There are now 13 acceptable documents.

An original, or a certified or notarized copy, of an UNEXPIRED passport is the only document that is accepted for both identity and foreign status. If you do not have a passport, you must provide a combination of current documents that contain expiration dates - we accept docs issued within 12 months of the application if no expiration date is normally available. The documents must also show your name and photograph, and support your claim of foreign status.

IRS will accept certified or notarized copies of a combination (two or more) of the following documents, in lieu of a passport:

National identification card (must show photo, name, current address, date of birth, and expiration date)

U.S. driver's license

Civil birth certificate

Foreign driver's license

U.S. state identification card

Foreign voter's registration card

U.S. military identification card

Foreign military identification card

Visa

U.S. Citizenship and Immigration Services (USCIS) photo identification

Hi,

As far as the ITIN, w-7, and taxes are concerned. You can go to dfa office but its NOT necessary. You guys can save yourselves alot of time and aggrivation by just making a color photo copy of passport and a second picture id like drivers licience and just have it notarized...no need for special dfa certification ect....the w-7 and 1040 must be signed by the philippine spouse. You can have sign the forms and fill them out when they arrive in the mail. The w-7 along with notarized copy is sent along with 1040 to the address indicated in the w-7 instructions, not to the usual tax processing center.

Jazzy, are you sure about this? That is, have you filed your taxes with W-7, and your wife received her ITIN? The reason I ask is because what I have read says that the notaries in the Philippines are not authorized to notarize U.S. documents per the Hague Convention.

Besides getting the certified document from the DFA, you can also use obtain help from abroad using an Acceptance Agent, and the only one in the Philippines is in Angeles City.

Hi all,

Well Jasmin got safely back to Cebu after a 2 hour delay in manila. She immediatly got to work and assembled pictures of her and her daughter for the embassy. This was and easy AR to deal with...:) She mailed the photos, passports and cover letter to the embassy today dhl for delivery by monday. I hope they decide to review it right away and process our visas!!! This has been a verrrrrrry long journey!!

Again I ask if your wife has successfully received her ITIN. I have read the IRS page you refer to, and also the page I provided a link to about obtaining an ITIN from abroad. And it clearly states that the notary must either be authorized by the U.S., or be in a country which is a member of the Hague Convention, which the Philippines is not.

"There are 13 documents that can be used to prove foreign status and identity. A foreign passport is the only one that can stand alone (i.e., establishes both foreign status and identity). If a passport is submitted, there is no need to submit any other documents. If a passport is not submitted, a combination of at least two other documents, with at least one containing a photograph, must be submitted with the ITIN application. The IRS will accept copies of original documents, if the copies have been properly certified or notorized by:

"the government agency (foreign or domestic) which issued the documents,

employees of the U.S. State Department located in U.S. embassies and consulates abroad, or

a U.S. notary public who is allowed under U.S. state law to notarize foreign documents.

It is strongly recommended that, if possible, authorized "copies" of documents be sent in lieu of "originals".

"In addition to the above, there is an alternative procedure for notorizing original documents when an individual resides outside of the United States. The United States is an official signatory of a multilateral agreement issued in 1961 known as THE HAGUE CONVENTION ABOLISHING THE REQUIREMENT OF LEGALISATION FOR FOREIGN PUBLIC DOCUMENTS ("The Hague Convention"). This agreement is one of many such multilateral agreements issued under the auspices of The Hague Conference on Private International Law, an organization of 65 member states whose official purpose is to, as much as possible, standardize certain legal procedures among nations in order to expedite international legal, commercial, and personal matters. "One of the Hague Conventions is called the " CONVENTION ABOLISHING THE REQUIREMENTOF LEGALISATION FOR FOREIGN PUBLIC DOCUMENTS"

"After the Hague Conference issues a convention on a certain subject, then each nation that wishes to avail itself of its provisions must become an official signatory in order for the provisions of the convention to apply in that nation. "Under the provisions of this Hague Convention, an individual in one signatory country who is required to present certified copies of certain documents to government officials of another signatory country may have these copies of documents certified, not by the agencies which issued the documents but rather by certain "competent authorities" of each country listed at the latter website noted above. These competent authorities will complete a one-page form known as an "apostille", which they will then either sign or impress with a seal. This apostille can then be attached to the copies of the documents needed by the other government, and serves as a legal authentication of the signatures on the documents, a certification of the capacity in which the person signing the documents has acted, or as a certification of the identity of the seal or stamp which is on the documents. The attachment of this apostille to the copies of the documents avoids the necessity of having the copies of the documents certified by the government agencies which issued them, or by diplomatic or consular officers of either government, and it avoids having to send the originals of the documents to government officials of the other country.

"Thus, in the case of an individual who lives abroad and who is filing Form W-7 with the IRS Service Center to apply for an ITIN, instead of attaching his/her original passport, national identity card, birth certificate, etc. to Form W-7, he/she can attach "copies" of these documents to Form W-7 accompanied by an apostille properly signed or sealed by one of the appointed competent authorities of his own nation. hey guys, just wanted to say God has blessed us with everything going so smoothly! Just wanted to fill you all in... Philip told me interview was very short, theold (LOL) American lady asked to see tax return, affadavit of support, thumbed through some emails and wanted to see our pictures. She asked if we want to have kids , how many,how did we meet(thru mutual friends/family ) LOL and what my religion was. We are 2 different religions(no big deal here! )THe interview took a really long 4 minutes LOL! However, the Pre-interview screener Filipina lady, apparently gave him HELL !! she wanted to read lots of the emails etc, well anyway I guess that is her job, just wanted to give all of you a heads up. We did go prepared with just about everthing we had just in case, bank stmts, tons of emails, fone cards etc etc for evidence of relationship. thanks again and GOd BLess !

Thanks for the heads up! I'm just curious if you are ethnically Filipina and if that had any bearing on the Pre-interviewer's treatment of your fiance?

I have to check with Philip about Delbros, he lives in Metro Manila area so I will give you all the info when I find out. LOL we are in no rush cuz he isnt going to leave till end of APril. No i am not Filipina I am a white chick LOL , yeah the pre screener saw our pics,demanding to read emails, blah blah blah apparently also there was some issues with her making some comment about Philip either to speak Tagalog or english(he speaks/understands both fluently, I dont know, i will get the story straight, it just seemed kinda weird.....but the interview was fine, will keep you posted!

Phil-Am K1 Information…

I'm almost ready to go final with this...

Pre NOA2

(K1 Introduction) - If you are just starting your K1 visa journey, please check out this information provided by the Department of State (DOS) on the K1 visa experience (CLICK HERE). I found this information very insightful when I first started. Please note that the “How to Apply for a Social Security Number Card” section is INCORRECT because K1 visa beneficiaries may ONLY apply for a SSN card upon arriving into the United States. Please also review VJ's K1 guide (CLICK HERE)

(Case Status) - Once you have filed your case and received your case number, please register on the U.S. Citizenship and Immigration Services (USCIS) website using the Case Status Online Tool to receive emailed updates concerning your case (CLICK HERE). NOTE: If you want emailed updates to multiple addresses then you must create multiple customer portfolio accounts. When your petition is approval (NOA2), this tool is of no further use to you until after the beneficiary arrives in the states, get’s married, applies for the Adjustment of Status (AOS), Employment Authorization Document, (EAD), and/or Advance Parole (AP) because this tool does not track the activity being performed at the National Visa Center (NVC) or the Manila Embassy.

Post NOA2

(1). The National Visa Center (NVC) number is within my signature. NVC assigns your case number once your case is approved (NOA2). They also may perform a preliminary background check from what I’ve read then forwards your package/case to the Manila Embassy. This process usually takes anywhere from 14 – 30 days.

(2). The Manila Embassy (USE) Packet 4, the phone number, a visa interview testimony, along with a sample Appointment Letter are within my signature block. NOTE: Packet 4 can be acquired from the Manila Embassy website which gives directions on what documents are required by the beneficiary for the visa interview. Starting 01 November 2006, ALL nonimmigrant visa applicants must use the online Electronic Visa Application Form (EVAF) to complete the DS-156 (Nonimmigrant Visa Application). To date, only the DS-156 has the barcode (on the first and last page) and is the ONLY form available online at http://evisaforms.state.gov. However, the USE is now including the form DS-156 with the barcodes as part of Packet 4. You may complete the DS-156K (Nonimmigrant Fiancé(e) Visa Application), and the DS-157 (Supplemental Nonimmigrant Visa Application) (The bank validates DS-157 form when you pay the visa application fee. The Packet 4 that is available in my signature is modified to read that the DS-157 is validated by the banks upon payment of the visa application fee. Unfortunately, the Packet 4 issued by the USE INCORRECTLY states that the DS-156 is validated by the banks upon paying the visa application fee) and the I-134 (Affidavit of Support) via the computer, type-writer, or handwritten. See the Most Frequently Asked Questions for the K1 visa forms (CLICK HERE). If you need to call the USE, dial 0 for the operator, and ask for the Immigrant Visa Unit. The average interview appointment is assigned approximately 100 – 150 days from the receipt of your package from the NVC. Beneficiaries are now sent a letter of receipt (CLICK HERE) (Thx PW and GaryC) accompanied by a document preparation letter (CLICK HERE) (Thx PW and GaryC) from the USE once their physical files are received. However, this is NOT Packet 3 because the USE ONLY issues Packet 4, and the letter of receipt is not always sent to the beneficiaries. Be advised that the pre-screeners and some of the USE staff are not very friendly or hospitable. Please review this instructional visa interview information (CLICK HERE) (Thx Sillygirl).

(3).The Department of State (DOS) number is within my signature. After your case is approved (NOA2) and reaches the Manila Embassy, you may call DOS instead on the Manila Embassy to obtain status of your case and make inquiries concerning your interview date. NOTE: DOS has no direct participation in the K1 process.

(4). The Visa Interview Appointments website is within my signature (the beneficiary's interview appointment and medical exam will be scheduled by the USE). NOTE: Please do NOT press enter after the case number is entered because that will not yield a result. Please click on the "Check Appointment" tab. If the appointments have been scheduled, the following will be available: Case Number, Visa Classification, St. Luke’s appointment Date, and Embassy Appointment Date, but if the appointments are NOT scheduled yet, the result will be "Case Number Not Found on Appointment List."

(5). St. Luke’s Extension Clinic (SLEC) information is within my signature. SLEC is where the beneficiary goes to take the medical exam and vaccination. The process takes two days: Day 1 is the medical exam (the beneficiary's passport will be taken and sent to the USE along with the medical exam results) and; Day 2 is the vaccination (the beneficiary will be given the x-ray film and the vaccination worksheet/record). NOTE: If the Manila Embassy does not mail the beneficiary the K1 Visa Packet 4 and the Appointment Letter, then call SLEC in order to pick them up at SLEC and take a copy of the NOA2, a copy of the NVC letter (a.k.a. Bureau of Consular Affairs (BCA) letter) (which should have the beneficiary's Manila case number on it), and a print-out of the scheduled appointment dates from the Visa Interview Appointments website. Be advised, the beneficiary's medical exam will be scheduled one week before the visa interview by the USE. Per the Manila Embassy Thread, we recommend that the beneficiary takes the medical exam anywhere from 2 weeks to a month before the interview to ensure the results are available for the Consular Officer and to prepare in the unfortunate event of unfavorable medical results. If the medical exam is taken anytime over a month before the visa interview, there is a risk that the results could be invalid, which means the beneficiary will have to take another medical exam before the visa can be approved. The beneficiary may reschedule the medical exam appointment with SLEC after the medical exam and visa interview dates are assigned by calling SLEC. Please don't forget to bring your passport, appointment letter (if received), passport photos (the size of the photos should be 2 inches by 2 inches [see Packet 4, page 8]), and the medical exam fee to your appointment. The beneficiary also needs to have the sponsors contact information (address, phone number, and ssn #) for the SLEC forms.

(6). The DELBROS website is within my signature. DELBROS is the company responsible for delivering the beneficiary’s Visa and POE information. The DELBROS delivery fee is paid subsequent to the beneficiary’s visa interview at the Manila Embassy. Per the Manila Embassy website, the current delivery fee/time is as follows:

* Metro Manila Areas, 135 Philippine Pesos, Delivered one (1) to three (3) business days after release of visaed passport to the courier

* Provincial Key Cities (ex. Cebu City, Davao City, etc.) 165 Philippine Pesos; Delivered three (3) to five (5) business days after release of visaed passport to the courier

* Outside Provincial Key Cities, (ex. Capiz, Leyte, Bukidnon, etc.), Cost depends on area/location, Delivered five (5) to seven (7) business days after release of visaed passport to the courier

NOTE: Per the DELBROS staff, the Manila Embassy can take as much as three (3) business days to release the visa and POE package, which is NOT included in the deliver times above. You may also call the Manila Embassy, dial 0 for the operator, and ask for Delbros, after the visa is approve, to acquire about the status of your visa delivery.

(7). Beneficiaries are required to attend a CFO Guidance and Counseling Seminar that are held in Manila and Cebu, whichever is more convenient, before traveling abroad (the corresponding links within my signature). Attending the CFO Guidance and Counseling Seminar is a Philippine government requirement which states, "Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs... " For more info (CLICK HERE). NOTE: The CFO Guidance and Couseling Seminar is not stated as a requirement within the Packet 4 instructions. However, after the visa is approved, instructions on attending the CFO Guidance and Counseling seminar are included in the visa and Port of Entry (POE) package received by the beneficiary. If the beneficiary takes the seminar before receiving the visa, then the beneficiary will have to return to the CFO in order to receive the CFO sticker anytime after the visa is received. Travel abroad is prohibited without the CFO sticker within the beneficiary's passport (the visa is within the passport). (8). The I-94 Arrival / Departure Record form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant’s visa and the arrival and departure portions of the I-94 at the Port of Entry (POE) when entering the States. The CBP Officer will keep the arrival portion and staple the departure portion of the I-94 to your visa where they stamped the beneficiaries arrival date. You will need this for the Adjustment of Status process. NOTE: Even though it’s simple, I have supplied this so you will know what it looks like and what is required to be filled out.

Just trying to save you guysa lot of hassle and money....color copy is only a few pesos and regular notary just brato...no need to pay more!!

Again I ask if your wife has successfully received her ITIN. I have read the IRS page you refer to, and also the page I provided a link to about obtaining an ITIN from abroad. And it clearly states that the notary must either be authorized by the U.S., or be in a country which is a member of the Hague Convention, which the Philippines is not.

Given the choices listed for acceptable documents required, I figured the certified passport route made the most sense for us since she just happened to be staying at the provinical capital with a DFA office nearby and it was a very simple process for her. The color copy of her passport was not notarized. The DFA letter has their stamp and signature.

I had sent her a filled up W-7 to sign and return in December. She had no reportable income from 2006, so I did not have her sign the joint 1040 return. Figgers the IRS revised the W-7 in January 2007 and also has changed the mailing address to Austin TX. The previous form was to be sent to Bensalem PA, which is where I sent my return. I hope to H it gets to where it's supposed to go. So, I guess I'll wait until...hmmm, maybe June to see if what I did was acceptable.

hi all! just need help asap about getting an SSN "before" getting married... if i applied for an SSN, what should i typically bring??? (what kind of docs/proofs)... in their application form, page 2, stated:

if you check "legal alien not allowed to work" you must provide from a US Federal, State, or local govt agency that explains why you need a SSN...

im not really sure with that statement...just confused here... and how long should i wait after applying for one...
