On the instructions in the K1 packet, the embassy calls for the fiancee's BC as well as BC of children even if NOT coming to America. My concern is that my fiancee's name is NOT on her child's BC.

Because a family friend accepted the child of my fiancee as her own in the first week of its life and registered herself and her husband on the child's BC, my fiancee is NOT named on her child's BC. Nor was there an adoption. Wanting to tell the truth, we revealed the child on the 1-129F, since the St. Luke's would most probably reveal her giving birth.

Though we have obtained the child's BC, will my wife's name NOT being on the BC cause a problem? The child will NOT follow her to America, and we have generated a notorized letter explaining this situation. What might we do to resolve this situation?

Hi Wind and titakey. Sorry to hear about the delays. It’s hard when you are put in a blackhole. But keep fighting.

Yet another concern. The NOA2 approval was dated Aug. 4 and is valid for 120 days. In our case, the interview will be ONE day longer than 120. Do I need to contact the Manila embassy to have them extend this time, or will this be automatically done? When dealing with the govt. and the letter of the law, ONE day can be the same as 100 days.

Here’s what the US Foreign Affairs Manual says:

“An approved K1 petition is valid for a period of four months from the date of Dept. of Homeland Security (DHS) action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry each other within 90 days after the beneficiary’s admission into the United States.” x x x

I called up the call center today but they said our case is not in Manila yet :(

Do you guys think we will have our interviews (October NVC's) on January next year?

It takes anywhere from 2~4 weeks for Manila Embassy to receive the physical files from NVC. January ~ February interview is likely.

What makes you think you will wait 150 days? The embassy will alwasy give worst case scenario when talking to a petitioner. There isn't any evidence here on VJ that anyone has waited 150 days yet.

From past experience, Manila Embassy is accurate when they give interview timeline. Last year, they said that wait time was 150-180 days. I waited almost 200 days from NOA2 until my interview date. With the holidays coming up, expect more backlog at the embassy.

Im curious about picking up the visa at the USE Manila after approval. i see that a few posts show picking it up 2 days after approval but the embassy info seems to suggest that it takes a week. Can anyone shed some light on this ?

Visa pick up is at the discretion of consul and is allowed on a case-to-case basis and almost always, only when the US citizen is present and personally requested it.

I also have a crazy question. Why cant you get married at the embassy ? It is U.S. territory.

You can get married at the embassy but your fiancee becomes your wife so you will need another kind of petition/visa (Immediate Relative) for her to make a US entry. A wife cannot travel on K1.

A fiancee is described by the USCIS as a “non-immigrant alien coming to the United States to conclude a valid marriage with a U.S. citizen within ninety days after entry.” As K1, note that she has to satisfy three requirements, the “(1) coming to the United States to (2) conclude a valid marriage (3)after entry” requirements.

On the instructions in the K1 packet, the embassy calls for the fiancee's BC as well as BC of children even if NOT coming to America. My concern is that my fiancee's name is NOT on her child's BC.

Because a family friend accepted the child of my fiancee as her own in the first week of its life and registered herself and her husband on the child's BC, my fiancee is NOT named on her child's BC. Nor was there an adoption. Wanting to tell the truth, we revealed the child on the 1-129F, since the St. Luke's would most probably reveal her giving birth.

Though we have obtained the child's BC, will my wife's name NOT being on the BC cause a problem? The child will NOT follow her to America, and we have generated a notorized letter explaining this situation. What might we do to resolve this situation?

Legally speaking, even if she is the biological mother, the child is not hers and should not have been mentioned in the petition since your fiancee's name is nowhere to be found in the BC. The proof of having given birth could have been explained away ~ the child was given up for adoption.

But since the child was already mentioned in the petition, telling the truth about the circumstances of its existence during the interview and being supported by a notarized letter (Affidavit?) should suffice but that is just my opinion and I am not a lawyer.

I assume you have consulted a lawyer already that's why you have a notarized letter? I would assume that what your fiance has is a notarized Affidavit, is that correct? If the lawyer said that the notarized affidavit should suffice, then she should be okay. Bear in mind, however, that there's a big possibility that her case would be scrutinized more by the embassy people.

I have found that odd about the hotels in the Philippines... NO IRONS ALLOWED! LOL! Of course when I was there, we just took my fiancee's iron from her place. LOL! We're rebels... Do yourselves a favor... TAKE A TRAVEL IRON if you arer not staying at the Best Western! Besides it's not breaking the law, just a house rule. (SMILE)

When they say they received NOA1 notice by email, does it mean it was sent to the email address of the Petitioner? Maybe, this was asked before and I just dont see it... :unsure::whistle:

I bought a round ticket.s to be in the philippines for mae's interview. I also bought a ticket for mae and will ask to pick up the visa at the embassy. If you dont get a ticket now it will be hard to get one at the last minute, holiday season. It is a gamble, but one I think is worth while.

I am debating if we should put the flight on the DS-156.

FMerz, did you ask DHL why they returned the packet to the embassy? At any rate, you can have another one delivered to St. Lukes and you can pick it up from there.

Elizabeth, if you are confident of visa approval, you may buy a ticket in advance but make sure its refundable just in case. Embassy advises against finalizing travel plans until after the visa is issued because as we are all aware, people can be put in AR for God knows how long.

hi we are almost on the same situation although my fiance is the biological father, due to drama on the ex's side, she refuses to cooperate as far as correcting the b/c to include my fiance's name in it. my stepson will not be following in the US as a derivative of the k1 visa however his name also appears as part of the petition. we are just planning to explain to the consul the whole situation, as well as provide information notarized affidavits and supporting evidences (TIN and school record) that he is the biological father. it's something that i am worried about but at this point there is nothing that we can do.

im thinking that the petition is only for k1 and perhaps the interview will be geared towards the beneficiary and not their children if it has been clearly stated in the forms (i believe I-134 and one of the DS forms asks if there are people to join or to follow the k1 petitionee) that k2 will not be implemented for the child mentioned on the g325A.

lets keep our fingers crossed and alot of prayers. hopefully our honesty will be sufficient at this point.

Thanks for taking notice of what i posted, they return my packet to the embassy cuz i wont pay the charge for them to deliver it in my door, and i figured that embassy can send it to me thru lbc cuz we have an lbc office here, so i figured it would be more convenient to do it that way, but just found out that embassy wont send packets thru lbc so it got me really worried, i dont mind just picking it up in st luke PW, but how would i let them deliver to st.luke and how would i pay visa fee without the appointment letter? please advice PW. Thanks so much to you PW, you are really an asset here.

You don’t need to show BPI anything to pay the visa fee so don’t worry about it. Just tell them you are paying the US visa fee.

Where are you located that you have to pay the courier to have the packet delivered to you? Malayo ba? (is it far from the city?) I don’t think LBC is accredited by the embassy to deliver for them.

It would be less expensive if your fiance calls the embassy from the US to request for the packet to be sent to St. Lukes. The number to call is 011-632-528-6300 local 5184 (call between 7:30 am ~ 8:00 am Philippine time). Have him call a few days before your medical exam then you should confirm with St. Lukes after two days if the packet is there.

You may also request for the packet by using the Call Center 1-909-101-7878. Note that calls made to this number cost Pesos 53 per minute plus applicable provincial charges. Very expensive since you will be put on hold a minimum of 15 minutes.
