Can a couple file bankruptcy if one is a resident alien?

I know someone who was talking about her and her husband filing bankruptcy, someone had mentioned that they probably can't without her getting deported.

I told her I'd ask on here to see if it was true or not?

It wont affect her immigration status. If she has no income it is probably better for her husband to file as single rather than jointly. They need to talk to a bankruptcy lawyer preferabably one with some knowledge of immigration.

If they were illegal aliens they probably would have no problems, but since they are legal, that may be a hinderance.

Nope - she won't get deported.

However, if they have to go on federal/state benefits, then the government can come after the husband/sponsor for the re-payment of the benefits.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
