HI ,

i got married on 19th feb 2009 and my 1-94 departure date is march 4 2009. i will be sending my AOS application in mail by 2nd or 3rd , my lawyer is doing it ( i had him hired long before), He is out of town till 2nd feb. is it too late to send it so i can get my Advance Parole ?

As the previous poster mentioned, AP can take upto 90 days to get approved. You mentioned your departure date on your I-94 is march 4 2009....once you send in your AOS, this date does not matter, as your status will be pending based on your AOS application.

Day 34 - Jan. 13-2011: I-751(ROC) Biometrics Appointment Letter for 1/31/11

Day 46 - Jan. 31-2011: I-751(ROC) Biometrics Completed

Day 138 - Jun. 09-2011: I-751(ROC) Approval Letter Received

Day 0 - Oct. 26 '11: N400 Package Sent

Day 1 - Oct. 27 '11: N400 Package Delivered @ Lewisville, TX

Day 5 - Oct. 31 '11: N400 NOA-1

Day 34 - Nov. 28 '11: Email: Placed in line for interview

Day 57 - Dec. 22 '11: Received yellow letter

Day 144 - Mar. 17 '12: Received fingerprinting letter

i am here on a B2 Tourist Visa , i am afraid that maybe filing just 2 days before my I-94 expires is too late.Is it OK if my papers reach after my I-94 expires.

And will i be able to get Advance Parole, doesnt matter when i get it . i wanted to know if i will get it, since my papers will reach the immigration office after my I-94 expires.

You should be fine, in the case of persons using a K-1 visa many for one reason or another have to file the AOS after I-94 expires.

Note, take care, you will have an expired I-94 card without any evidence of AOS pending status, once you do get the I-485 NOA1 letter carry a copy of it until you get EAD or Green-card.

AP should be approved within 90 days of filing.

And also you may want to to file for EAD if you did not include the I-765 with I-485, you will need to wait until you have I-485 NOA1 letter, include a copy of the letter with the I-765 and base the I-765 on pending I-485 (C )(9 )
