Can K1 be denied?

I have been dating my boyfriend for four years now and he is a US citizen. I applied for F1 to study for my masters in the US but i was denied 5 times. I decided to go to the UK and now i'm almost concluding my program. My boyfriend is thinking of me applying for a K1 visa but I am so scared that my previous denials might result in the denial of the K1. Does anyone have and advice on this. Thanks :help:

Just follow the Guide for K-1 at the top of this page. If you have been together in the past two years and can prove that with boarding passes, tickets, visa stamps in passports, photographs together, hotel receipts, etc. (not all necessary but the more, the better), then you can confidently apply.

Your fiancé would need to earn at least $18,000 a year and both of you must be eligible to marry (single or divorced).

K1s can be denied, as can any other visa. Denial of previous visas, such as tourist visas or the F visa you applied for don't necessarily mean your fiancee visa will get denied, it depends why the previous visa got denied; for example if it is because of previous overstays or drug use, you'll have problems again but there is a waiver option.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

K1s can be denied, as can any other visa. While the OP has given no information that would lead me to believe there would be any problem with a K1 process, if the visa could not be denied, we would call it a "registration" instead of "petitioning" followed by "applying".

Yes, a K-1 can be denied.

If an F-1 was denied for a reason that doesn't apply to a K-1, such as because of failure to prove non-immigrant intent, then that's not a problem at all in the K-1 process. Just be sure and disclose it when asked.

If an F-1 was denied for a reason that does apply to a K-1, such as material misrepresentation, criminal record, previous overstays, previous immigration violations, etc., then that could easily be a problem for the K-1. It might be a problem that can be overcome with a waiver, or it might not.

If you want to describe the reason for the denial, you may get more precise information.

Thanks. The reason for the denial was as an intended immigrant and that they do not think i have enough funds to finance my program.

The K1 can be denied...if USCIS feels its worth a denial. Not meeting the requirments is one reason.

When people say this is worries me. I thought it wasnt just your fiancee who had to earn this much, as long as you had say their parents for example say that they would support you if anything happened.

4.2006 Met online.

3.26.2008 Became official.

5.14-7.2.2008 Ash's visits Texas. First time we met :D <3<3<3

8.6-28.2008 Haley's first visit to England!

8.13.2008 Meeting with immigration lawyer in London.

11.12-12.2-2008 Ash's visits Texas for Thanksgiving (12.1 Ash proposes!)

12.26.2008-1.13.2009 Haley visits England again, Ash comes back to Texas, too.

1.28.2009 Ash goes back to England :(

2.9.2009 We started I-129F forms!!

2.23.2009 Mailed I-129F =)

Yes, if there are additional sponsors with sufficient income, who will complete the necessary forms, the income of the petitioner is not an issue.
