We received Packet 4 today and our interview is scheduled for July 3rd! :dance::dance::dance: Finally! :star:

CR-1:

14-Dec-05: Sent I-130 to London for DCF

28-Dec-05: Letter from Embassy denying due to LLR

17-Jan-06: RFE from TX due to "lack of payment"; USCIS won't accept credit card form from Embassy

01-Feb-06: Sent new I-130 to TX with personal check

13-Feb-06: NOA1

02-June-06: NOA2

05-June-06: Case received at NVC; case # assigned

26-June-06: DS-3032 Choice of Agent rec'd via snail mail

06-July-06: DS-3032 COA mailed; AOS bill mailed

24-July-06: IV bill generated

31-July-06: I-864 rec'd via snail mail; IV bill rec'd

31-Aug-06: IV bill mailed (delayed due to move to US)

If I may ask a beginner's question, I notice that both your I-130 and I-129F have been approved and actually I-130 was approved even before the K3 was. I thought with I-130, the beneficiary gets the greencard directly whereas with K3 it's only a temporary non-immigrant visa, with AOS to follow? Just curious why you opted for the K3 route while you have both your petitions approved. I'm pretty sure I'm missing something basic. Is it that with K3 you and your spouse could be together soon, since K3 would give the spouse a visa to visit the US? If you were to go the I-130 route, any idea how long it would take from the time of I-130 approval for the spouse to be here? I'd appreciate if you could explain.

thought i would chip in as im here :D

yep the K-3 was brought in as the CR-1 was taking ages and was meant to allow people to be together sooner. We all (or most) do the CR-1 AND the K-3 because you just dont know how long its all going to take.

while the CR-1 does indeed have the benefit of the green card, it still does generally take longer. Some folk enter on the k-3 and then come back to their home country for the CR-1 interview and dont adjust their status, just wait for the greencard.

its hard to say how long it takes from NOA2 to actual visa with the CR-1, embassies vary, but its a good few months due to the various forms that have to be sent back with the CR-1.

Yes, the whole reason for pursuing the K3 was so that we could move to the US quicker (we are both in the UK and I didn't want to leave him here.) When we started this process the I130 was taking so much longer than it is now, so the K3 seemed the best option. It appears that right now the K3 has slowed down significantly, so the I130 might be just as quick for someone applying now. :huh:

The best thing to do is look at other people's timelines and see what is happening at your Embassy. Right now it is looking like we will probably get our I130 interview sometime around October. (We will be coming back to the UK rather than AOS since it is quicker)

I'm a relative newbie too, but the answer to your question is yes, if you decide to pursue the I-130 route. You could always choose to withdraw your I-130 once you get a K3 for your spouse. (Or do people just simply ignore it?? I don't know.) But as you may know, with K3, you have to apply for an AOS, whereas with I-130 you get a greencard directly.

He would not have to go to Sydney for the interview, it is just an option. The other option is to AOS so that he would have the interview in the US. More paperwork, more time waiting. We'd rather not go that route so that we can get it all done with ASAP. ;)

Hum... I don't think you can withdraw the I-130, Joe. In fact, you have to file it even before you can send in the I-129 for a K3. I think it's a matter of "stalling" the I-130 if indeed my husband is granted a K3. But the question still remains: Will he have to go back to Australia for the interview if he comes here on a K3? I thought the interview would take place here, if he's here. But I've seen two different posts (including this one here we're tailing on), where people talk about going back to the spouse's country for the interview, if they are in the U.S. on a K3.
