Sorry all I posted this question under the regional discussion but I havent had any responses so I thought I should post here.

I have a question - just to reassure myself smile.gif

My US fiance works as a cable tech. He works for a company that contracts for WOW - unfortunately he isnt paid a salary he gets paid by piece work - according to his last tax return he made $32,000 so that is well above the criteria for a family of 3 (his mum was on his last return as a dependant - she is waiting for her disability claim to go through once that is through she will no longer be dependant. But this wont happen before I get my visa so we are calculating a family of 3). Our predicament is that his employer can give him a letter saying he works for the firm, when he started etc but he cant put down a salary or what he earns - he can only state that his "income is reflected on his tax return". Do you think that would be ok? - He has tax returns for 2005 and 2004 and he didnt put a claim in for 2003 so nothing for that. I know most of this is really needed for the AOS but for my interview I need to provide the Afidavit of support and the letter from his employer and bank letter. Unfortunately he doesnt really have any money in the bank either nor does he have any savings:( I dont think we need a co-sponsor - what do you all think? Plus I have a house here I will be selling so that will be my money and it may be a considerable amount.... should I take a quote from a valuation to my interview?

Any suggestions/advice??

MAY 2007:RESUMED THE VISA APPLICATION

6 June 2007: Medical @ 2.30pm - need to get anew GP letter and psychiatric evaluation

7 June 2007: INTERVIEW @ 10am - waiting for new police record letter

3 July 2007: APPROVED/Visa arrives

I don't see a problem with the letter from employer as long as he has his tax returns..but see what everyone else here thinks.. The house quote... I think that would be a good idea to bring a quote and possible letter of intent to sell or something..

July2009 requested Senator inquiry again.. response "with officer, required extra processing" if no response check back 6 months!
Dec 09 requested senator inquiry again, Jan 8 2010 requested more than "general inquiry" senator Jan 11, 2010 Senator requested supervisor
Jan 12, VSC told senator's office we wld recd notice in mail 7 - 10 days Jan 20, 2010 I601 DENIED.... letter dated Jan 14, 2010
April 2010, granted 290b approval to send to Appeal for review

October 2011 Appeal denied due to fraud, now dumped by husband, now with Canadian Arabic woman from Tunisa for Canada residence.. processing Immigration with her now

thru Canada

July2013 He ws deported back to Egypt almost a year ago due to out of status for almost 2 years

Can't answer your question, only make a few observations for you to think about.

- Your fiance is not in the most common employment situation, but it's not unique. His income situation is a bit more unstable than many, but few income situations are 'rock-solid'.

- Good thought to present your own financial information as well - after all, at this stage you only need a US sponsor if you don't have sufficient financial resources of your own. How is the real estate market in the UK - are you likely to be able to sell your home quickly?

Do you think that if his work situation is unstable it may be a problem?? even if his tax records show he gets more than the amount required? if at this stage it is ok will it be a problem with AOS? Would I need a co-sponsor at the AOS stage? I wasnt planning on working straight away when I get there as I am hoping to get a considerable amount on the sale of my house here in Uk and with most of that money we will buy our own house there (if we can buy it outright with no mortgage). I think the house market is kinda ok still - I hope it sells quick - I may loose some money on it as the house desperatly needs decorating and all new flooring, but there is no other option other than selling as renting wouldnt be worth it. So you also suggest it may be a good idea for me to take a quote from an agent for value of the house?

They may see the quote on worth as just that, an estimation of its worth, not how much you will get for it..I know it was acceptable to a UK court for divorce proceedings but this isnt the UK court system lol.

It certainly can't HURT to have one; maybe also something that shows it IS, in fact, for sale right now?

I know I took a letter from my solicitor saying how much i was getting for the house buy-out - I didnt actually GET it (the money) til after the interview - but as it turned out they asked me for NOTHING, not even the I-134

Lina,

Your fiance's income history is good but his income is not as stable as someone who is on a salary, which is not to say that it's unstable. But if a person on a salary gets sick or injured they are often covered for a while whereas if a person who works piecework as a contactor gets sick or is injured their income stops. (Unless they have made their own arrangements to protect against this possibility - you don't mention anything about it.)

I can't answer for how the consular officer who handles your visa application is going to look at these things, and I couldn't even if you gave me all of the financial information that you're going to present. But perhaps you're beginning to get the idea of what you need to do - present the most complete package that you can, try to identify potential weaknesses in the situation and what you have to strengthen any weaknesses you identify.
