I was curious if anyone can help on this procedure? I married a Japanese lady in the states and we are living in a house in the states right now. We have been married for about a week and all she has is a passport on the waiver program. She has 3 months to stay here and we just got started on her I-130 and Status adjustment paperwork. She has about 1 month and one week to stay. Can we get that extended? And does she have to go back to japan?

You want her to stay here until she gets her GC. Her overstay will be forgiven while adjusting status.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You can't extend on the VWP, she will have to leave the states and re-enter thus renewing her VWP stay for a futher 90 days...Can be risky as Immigration officers may deny her as she is now married to a US citizen and has an I130 pending. Also overstaying the VWP is a bad idea as she will then almost certainly be classed as a 9B1 overstay which will require a waiver which will mean that she can adjust in the US. Best advice leave the US get the CR1 interview in home country.

Doesn't sound correct at all from what I "know" .

LOTS of people marry and adjust status while out of status without any problems. From what I've "seen". The worst thing is if the beneficiary goes home before obtaining their GC!

Best if you get a immigration lawyer.

:blink: Easy cowboy --- adjustment of status is not as easy as it sounds.

How long after she entered did you marry her?

It will be on you both to prove she had no intent to immigrate when she entered the country. Tricky stuff.
