Hi guys again,

do you think that we would have any problem as we plan to enter the US together and then my wife plan to live outside the country (she is the US citizen) for 3-4 months to complete her education in Italy? The fact is we cannot postpone our entrance to the US because I will start school there. But after she finishes, she would join me in the US.

Do you think that will be fine?

You would enter the US at the same time; and then she can go back to Italia e finire la scuola. It should be ok ;)

Yeah, I mean, this is the plan once again:

1. My wife starts her school in Italy this September 2009;

2. I apply to business school and (hopefully) get in;

3. In the meantime I apply for the green card, so to have it in hand by Febraury 2010;

Then we have two possibilities:

I. I get into B-school:

i. We enter together the US in May and open a joint bank account, set residence at her grandma's house in Missouri, etc. and then we come back to Italy to take care of last stuff;

ii. At the beginning of July I go back to the US to move into our new house-to-be, start classes by the second half of August;

iii. My wife finishes her master's program at the end of September and she moves to the US where we will live together. We buy a co-intestated car, etc. We are happy! :)

II. I don't get into b-school:

i. We go to the US before my visa expire to activate my green card. We did same things at point i. above;

ii. We go back to italy, my wife finishes her master and by the end of september we move to the US where we can find a job;

iii. I reapply to b-school for 2010.

What do you think about this?

We have many proofs of the bona fide of our marriage, like pictures of our wedding in Italy (where both families attended), flight tickets and two years-old conversations, and so forth. She has stamps on her passport showing that she visited me twice before getting married. We have a co-intestated bank account here in Italy, and we really love each other! I don't know what other proof we could provide?

Another thing: once I get a green card, I will live in the US. But I could exit the US for brief amount of time, right? I ask because my MBA will likely (even before it starts!) require me to take 7-10 days trips abroad every let's say couple of months (career treks, trips with future classmates before classes in August, internships, exchange programs, etc.). Would that be ok?

P.S.

- Another way could be getting a F-1 visa and then adjust of status once in the US together... But I don't think that would be possible, would it?

I think you will be okay in either scenario. You are allowed to come and go after receiving your green card. And I could be wrong, but I have seen on other boards that it is near impossible if not impossible to get an F-1 visa when you are married to a U.S. citizen. The only non-immigrant visa you can get is the K-3.

As far as the domicile question above, on the 1-864 where it asks for "country of domicile" my consulate told me that it is much easier to just write "Denmark with the intent of re-establashing domicile in the U.S." and then attach a letter telling what I have there now and what my plans are. It just simplifies the paperwork. Check with the embassy and see what they recommend!
