i was about to get a passport for my son,when we noticed in dfa that my family name was mispelled on my son's birth certificate.instead that my family name starts with a letter g,they put a c instead.i was adviced by the legal counsel to just follow what's on the bc.,because,he says,the us emb will going to recognize what's in the bc anyways.would following the bc won't post any problem later on?

It might cause problems later especially for your son. Much better to correct the error now and have the hospital do the correction then take it to the city to have it recorded correctly. Will the USEM say anything now maybe, maybe not, but why keep a potential problem lurking in the background.

Since the error is already on the Birth Certificate the hospital is not the proper agency to correct it . It is either the Civil Registrar or the Regional Trial Court, depending on the error, whether it is substantial or not.

Go to the NSO office nearest you or the the Local Civil Registrar where your son was born and inquire about your problem. There are cases that even one incorrect letter will have to be brought to court for changes.

I must disagree with the legal counsel because you and your child must have the same surname spelling in all your documents. The USEM is quite strict with this matter so better correct the error now, rather than face delays in the future

I would contact the NSO first to make the corrections, and follow the process they prescribe. Bring any supporting documents you have, such as baptismal records, birth announcements, and a letter from the attending physician, nurse, or midwife. You may need those documents again at the USEM interview.

Get a lawyer for this issue. My brother's last name was wrong in his birth certificate. He had to hire a lawyer to correct it. Just bring additional documents to support your claim.
