guys!

I am filling out I-864 and i have a problem!

Part 5, Q: 21

If I am the one from line 10, and then my husband is married to me- he has to put 1 in c). I know it says do not count anyone twice but it's just ridiculous ! shall we skip c) and leave it blank? so it will come up to 2 ppl total?

Part 6, Q: 23

My husband is unemployed since May 2008 - he gets unemployment. So i dont think that we can count it as an income right? That money is not based on his work! so I am assuming that this is not an income!

So what should I put in this part? Zero? We have joint sponsor that makes enough money to sponsor both of us :) haha joke :)

If this question is already somewhere on VJ please forgive me if I repeated it - I couldn't find it

For part 5 you put 1 in 21a. This is for your husband and 1 for 21 b. That equals 2. Putting 1 in C means there is a third person that is not on this petition that you have sponsored in the past. I got an RFE for this question so I know for certain that you only put 1 in 21a and 21b. (this is assuming you are not bringing children).

For part 6 I only put my income because I did not count my husband's money or income toward the poverty line. Hope that helps. :thumbs:

okay so 21 c should stay blank even though my husband is married ? it makes no sense to me!

and question about sponsor's income - i cannot put mine there because i am the beneficary! he is sponsoring me.

so i have no idea what should i put there *&^%$#%*)_)(*&^%

For I-864 form, petitioner should check part 3, item #8: Yes

And, write 01 in item #10

In part 5, item #21a: write 01 and 21b (petitioner): 01 (it is already there)

It is mentioned there: DO NOT COUNT ANYONE TWICE

So, in item #21c: write 00 (and 00 for rest of the column if no kids or dependent)

Does anybody know if the I-864, affidavit of support, I-485, Application to Register Permanent Residence or Adjust status, I-131 Advanced Parole Travel Permission, and the I-765 application for employment authorization has to be notarized ????? (for the AOS of course)

Tell truth. He's unemployed, so check the box indicating he's unemployed and fill in the date he became unemployed. I'm not sure there's a hard and fast answer to what you state as income in that case. I would indicate the total income for 2008 including any unemployment benefits paid in 2008. That combined with the statement above it should paint an accurate picture of his financial circumstances. The fact that you included an affidavit and supporting documents from a joint sponsor indicates you already know the petitioner does not qualify.

Oh I will tell the truth! It is just the matter of what do they understand as an CURRENT INCOME - to me it is the money that he is earning at this moment - am I correct!? its not the 2008 total income but whatever he is making in 2009.

I know that I need a joint sponsor because he gets unemployment benefits - and i think this is not counted as an income.
