:( I filed the forms I-130 and I-129F last December 22, 2008. I was told by an INS officer that i can file both forms at the same time. I received the I-130 NOA around January 5th,2009. It's now almost two months and i haven't received any receipt regarding my I-129F. So I called USCIS this afternoon regarding the I-129F. Apparently USCIS didn't received my I-129F or lost it since i filed both documents at the same time. I was told to either wait for a response from them within 30 days or file another I-129F. I used a register mailed and also have copies of the original documents that i sent. I don't know if i should wait for their response or go ahead and file another I-129F. But i am not at fault regarding about the lost documents... What should i do from here? Any advice is deeply appreciated. Thank you for taking your time regarding about my concern...

The CSC is all ready giving approvals for December filers of the I-130 for IR/CR-1. If it was me I would not refile the I-129F and just go with the I-130 as it may be approved soon.

I tend to agree. If you file it now, you probably only slow down your process.

This may be a blessing in disguise :)

"you fondle my trigger then you blame my gun"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

Thanks for the reply and info.... So you think the best way for me is to just not file for the I-129F... I already received the 1st NOA regarding about my I-130... So what should i do next? I was told that the I-129F is just the fastest way for my wife to get to the US... So I guess that's not really true?

well, heres what will happen if you file the 129f now.

your current "priority date", in other words, your place in line is Dec 08. If you file the 129f, your "priority date" will change to Feb 09 and you will basically be moved to the back of the line so to speak. You will essentially be adding 3 months onto your wait time

If I was you, I would just stick with the Cr1 and be happy that I am at CSC, they move MUCh faster than VSC.

good luck in wahtever you decide :)

yes, the 130 is a petition for a cr1 visa or an ir1, if you have been married over two years.

you can check out the current processing times on the uscis website, but a more accurate idea of what they are working on would be checking out the vj timelines or seeing the recent approval threads in the "cr-1/ir-1" forum.

K3 is nothing but trouble! Keep away

Stick with the I-130. You'll get your spouse here faster.

Thank you all guys for the encouragement, we're going to follow your advice on this matter and just go with the CR1.

notime4haterz, i read in your profile that you're taking the K3 route, so you're speaking thru experience  , what's happening with your petition now? thanks
