I would try to gather more evidence about the relationship - anything and everything I could get my hands on. Anything you may have done to accomodate her once she is here, any evidence of leases you may have had for your time over there - anything at all.

It sounds like you have addressed the tax issue. Don't let this fall down because of questions of the bonafides.

What is the anecdotal evidence regarding interviews in Bangkok wherein the US petitioner attends? Do you need to get on a plane?

I have a ticket to go there this Thursday. She is supposed to go back tomorrow to submit the additional evidence. I don't think they let the petitioner attend the interview in Bangkok. I sent her 10 more pages of phone bills, and some more wire transfer receipts. I am pretty sure this is all related to the IRS, and I think I got that covered pretty well.

Does she have an appointment for tomorrow - or can that be delayed till you arrive?

Even if you cannot get in, she can tell them you are waiting outside.

I seriously would not let her go in there on her own with no more relationship evidence than you say you have to offer. CO's can use other excuses for a denial - that's where 'totality of circumstance' comes into play. The IRS lien can be part of an excuse - or it can be a test of how much financial information you are will to give to her to carry in to them.

I do not wish to alarm you. But I do think this is serious now and I would encourage you to re-think your present plan.

Definitely attend the interview if possible. It can't hurt you, and often helps. :thumbs:

In nearly all cases, the return trip to submit additional evidence does not include an "interview" or even any conversation beyond, "Here is the information requested" and "Thank you."

Does she HAVE to be?

I'm at work and can't spend a lot of time on this. But in skimming through the consular reviews for Bangkok it LOOKS like they take follow-ups on Wednesday and Monday. Did they specifically tell her to be back on Wednesday or did they give her options?

how did they find out about the lein? did they run a credit check?

Many people owe the government massive amounts of money for student loans and such, if they were to deduct the monthly payments owed on those loans alot of people might not qualify... :angry:

But if the OP is planning a trip there anyways, I don't see that it would hurt to delay the submission of the additional info requested by the consulate until such time that the OP is there to personally go with the wife to the consulate....unless of course there was a specific date mentioned on the 221g in which to return and submit the evidence.

This is what I am saying to you about totality of circumstance and the like. Perhaps there was a whiff of the lien in some of the paperwork. Perhaps it came up during the interview in some of the questions to your wife.

I actually spent about an hour last night googling any combination of phrases regarding the IRS, Federal tax liens and visa processing. I could come up with nothing that would give DOS the authority to deny a visa based solely upon a person having a tax lien against them.

I actually think this is sort of fishy.

They knew the exact amount that I owed. So they found out somehow. I'll see what happens tomorrow.

So this is what they sent me:

Dear Mr. Scott

During the interview, the applicant submitted only 5 photos, some money

transfers, 2 cards. Your 2007 income is above the poverty guidelines,

but the consular officer has noted an IRS lien of 11K from JUN 2008,

which would bring the income to below poverty guidelines. Thus, in

order to process the case, the applicant needs to submit more

substantial evidence of relationship and information about the lien.

A letter explaining the tax issue.

Copies of the statement I get from the IRS every month showing that I am paying them.

2008 tax return showing over $50k

W-2s and 1099s from 2008.

More phone records.

My last pay stub.

Wire transfer receipts.

So I am hoping this will do the trick.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.
