Timeline

My wife was denied because I owe the IRS money. I have been paying them $400 a month on a payment plan since last August. She got a form 221g. They checked "other" and put this in there "Information related to IRS lien against the petitioner"

They also checked the box "Evidence of your relationship with petitioner" Having hard time figuring out why that is an issue. I sent everything. Phone bills, bills for both of us a the same address, copies of all my passport pages showing that I obviously lived in Thailand, photos etc. etc.

Seems like the IRS thing it what is killing me here.

Any ideas?

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Does the $400 per month put you below the poverty level? If so, then when it's paid off, apply again. If not, find some way to remove the lien. The IRS files a lien only after the taxpayer fails to make arrangements to pay off the debt, so it is kind of an extreme measure. That's another factor in this situation.

As to the other reason, failure to prove the relationship, maybe you could provide sworn affidavits from friends/relatives who can verify that the marriage is real. I assume you already provided the marriage certificate.

Did you provide details on the debt/payment plan you have for your IRS debt? The way I'm reading it is that they're wanting more detail, re. the IRS lean, probably to see how this affects your income to see if you're still above the poverty level as required.

How did they find out you owed the IRS? Did you file taxes for the last 3 years and indicated you had filed on the I-864? Was you income 125% or more above the poverty line?

My understanding is as long as your income is above the 125% threshold and you have filed your returns for the previous 3 tax years a lein would not be a basis for a denial.

I am very sorry to hear this. I know of TWO K-1s approved very recently (not from Thailand) where the petitioners have ongoing payments to the IRS. I do not understand, if you are paying into an approved payment arrangement, what's the problem? I have done this at various times in my career and I never considered it to be a problem, they agree to the terms and so do you, then you pay. I don't get it. Look, I don't feel comfortable giving out any names, but I will message the ones I know and they can send you a message if they want. This sounds preposterous to me.

If it is in fact a denial, have a lawyer (a tax lawyer, not an immigration lawyer) file an offer in compromise to settle the IRS bill. The petition and denial should be evidence enough of circumstances warranting a compromise.

So this is what they sent me:

Dear Mr. Scott

During the interview, the applicant submitted only 5 photos, some money

transfers, 2 cards. Your 2007 income is above the poverty guidelines,

but the consular officer has noted an IRS lien of 11K from JUN 2008,

which would bring the income to below poverty guidelines. Thus, in

order to process the case, the applicant needs to submit more

substantial evidence of relationship and information about the lien.

So I sent my wife the following:

A letter explaining the tax issue.

Copies of the statement I get from the IRS every month showing that I am paying them.

2008 tax return showing over $50k

W-2s and 1099s from 2008.

More phone records.

My last pay stub.

Wire transfer receipts.

So I am hoping this will do the trick.

I would try to gather more evidence about the relationship - anything and everything I could get my hands on. Anything you may have done to accomodate her once she is here, any evidence of leases you may have had for your time over there - anything at all.

It sounds like you have addressed the tax issue. Don't let this fall down because of questions of the bonafides.

What is the anecdotal evidence regarding interviews in Bangkok wherein the US petitioner attends? Do you need to get on a plane?

If you were joking with the OP, perhaps you should have indicated that in your post or PM'd the OP directly? These threads are here for posterity, long after daboys has cleared up his issue. If someone has this happen to them in the future, and comes across your 'joking' remark, without any knowledge that it was jokingly meant, they may be alarmed for no reason.

Maybe you should think before posting, and think of the stated purpose of VJ, "to educate and provide general information regarding family and marriage based immigration (K1, K3, IR-1 Visas, DCF, etc) for a spouse, fiance, parent(s) or other close relatives to reunite and bring together families."
