I am 20, got married to NON-u.s citizen/resident, not in school, freelance CAN I FILE?

I am 20, got married to NON-u.s citizen/resident, am currently not in school and do freelance makeup for income (very little to none income) and my parents still claimed me as dependent in their last taxes (I did not know they had done so). I want to know if I can file.

I have filed a petition with the USCIS for a CR-1 immigrant visa w/ 2 yr conditional greencard apon arrival for my Pakistani husband. I will need to show either 1040's, 1099's or W2's (no clue what these are) or tax transcripts of at least most recent tax year.

I have no job per say, only free lance when I need cash. I quit high school in late 2007 and got my GED mid 2008. I plan on going to college to finish my prerequisites (chem,science,organic bios, physics, maths) in 2010, once this visa process is taken care of...whether he comes here or not. My parents have claimed me as a dependent this year already and I wanted to know whether I can file and get some sort of tax documentation so that I can show it for the visa process for the affidavit of support form.

I will not be filing as married because my husband is not here and does not have an ssn. Also, I believe if I file as married it will get my parents in trouble for filing for me as a dependent, even though they just recently found out I had gotten married, a month after they filed.

What are 1040's, 1099's and W2's and who do they apply to. Can/should I file for them... and how? What taxes should I file for????

Can I use any free tax helping software or something? Can anyone recommend any? How's turbo tax? Would it work for someone who has never had a paycheck type job?

Tax laws is very complicated especially in your situation.

Under the tax laws, your parents cannot claim you as a dependent as a "qualified child." A qualified child is child who receives more than half of his/her support from the claiming parent and the child is 1) under the age of 19 at the end of the year, or 2) under 24 and a full time student, or 3) totally dependent on the parent and has a permanent disability. You don't qualify under this definition.

It's likely that your parent can claim you as a dependent as a "qualified relative." You must have earned less than around $3,500 (I don't know the number for 2008) for the year and your parents provided more than half your support. A qualified relative who is married CANNOT file a joint return with a spouse, but can file a "married filing separately."

From the information that you provided, your parent can claim you as a qualified relative. You can file your own tax return as a "married filing separately" and listing that your parents claimed you as a dependent.

If you don't know what a 1040, 1099 or W-2 is, you SHOULD NOT do your own taxes. There are lots of free help to file your taxes. Look up the Volunteer Income Tax Assistance program in your town. It is sponsored by the IRS. Bring a copy of your parent's tax return and any other paperwork that you think will be helpful.

On the immigration side, how are you going to met the poverty requirements in the Affidavit of Support? The US is not going to let someone in who they will have to give support to. You seriously need to consider how you will support your husband once he is over here.

get ur parents to co sponser ... then u won't need ur tax info.

An expensive way to start learning about taxes. Why not ask your parents for some tax advice or simply go to IRS.gov for the information.

This is completely incorrect. As the primary sponsor, she will always need to submit her own I-864 form; for which she needs her tax information --- including in this case a letter explaining why she was not required to file.

by tax info i meant you will not need to file your tax return...

Len u r rite... but since she is saying she does not have the income y can't she attach a statment that she is a student and dependent of her parents thus not required to file a return? m sure USCIS will not require you to file if IRC (internal rev code) doesn't manadate it

However indeed it is always better that the petition him/herself culd support the beneficiary. In past some counslate have completly refused to even look at co sponser.. however co-sponsership is common @ ISL

Also be aware that ISL embassy is V Vpicky about affavd. of support... make sure all the required info. is submitted

I agree. I'm 26 and I have continually been working (Sometimes more then one job) since I was 15. I started out working at Greyhound dumping the toilets on buses. It was a nasty job but it gave me a LOT of independence. I've read many of your posts and it seems that you rely on your family a lot. It's nice to have family that is really close but before you bring your loved one here you should carefully consider how you can live without the dependence of others.

I got all my tax questions knocked out in about 1 hour on the IRS.gov website and over the phone.

I'd say get your parents to co-sponsor for your husband.

well i must agree that one shuld work .. and it is not difficult to school full time n work @ the same time.. done that myself ..

but if u r to get a job @ this point it wuldn't really have much of an impact on ur affvd of support except that you culd attain a job letter. u will still require a co sponser!

Getting a job sounds great everyone....but do you really think that I haven't tried keeping one already...I mean if I am willing to go to peoples houses, work, events and what not to do their hair and makeup don't you think I would be willing to get any job a bit more decent....a bit more stable? The problem is that I cannot.....my father has ruined every chance of keeping a job I've had since I was 14 years old and does not want any daughter of his to work (a man's job) the only exception would be to sew, cook or become a beautician...a woman's job. Every time I have begun working at mcdonalds, department or grocery stores, the mall and even a friends father's office as secretary my father has kicked me out of the house. At the time, I have no other place to go...no friend willing to take me in for a long enough time to get my own room...studio...apartment, anything. So far, I have been making the money I need in order to file and send mail and buy a ticket to Pakistan and every other need of mine's is by freelancing....the only thing my father cannot argue with, although he hates the fact that I have to leave the house, and my chores to do it.

He wants me out of the house soon because he cannot stand looking at me since I got married to who I wanted, rather than an arranged marriage like he said he would make me. He had told my mother to tell me last month that I had a very limited amount of time to get my things and leave the house.....and he said I should be grateful he is giving me the time that he is with how I have disgraced him. Since I have no other place to go I bought myself a ticket to Pakistan (with my husbands assistance) and will be staying with him now.....as if I have any other choice.

My parents will not joint sponsor my husband, the only reason they kept me as a dependent is it would be so disgraceful to tell the guy that does their taxes that I got married.Apparently, people would ask questions. Although, I do have a friend who is more than willing to become our joint sponsor and provide all of her tax information for the purpose...I can only hope it is enough

So, I do not have many...if at all any options whatsoever. The options I do have left are fairly bad. But I am trying to make lemonade with what I DO have....and this is why I am trying to get as much info about taxes for myself...and what I can do about them in my very strange....and unique situation.

Of course there's something you can do and it's already been suggested. Call the IRS for direct assistance from them. Chances are, they'll tell you your income is below the minimum for needing to file a tax return. If so, that's all you need for NVC about your own tax situation. If they say you need to file any returns, they'll help you do it.
