HELP: Cancelation of K1

members,

I have few question about K1 process. what happens if I decide to cancel the K1 visa process. currently the status is at NOA1.

Questions:

what happen to the beneficiary? will she no longer be able to enter US ever again if we decide to cancel the K1 process? and can we apply in the future if we decide to move forward with K1 visa again?

If we decide to move forward with process. How much time does she have to enter US once she get K1 Visa approved?

is there a time period that she must enter US once we get visa?

2008/12/15 I-129F Sent.

2008/12/16 I-129F Received by CSC: AND NOA1 issued same day.

2008/12/18 I-129F Check cashed

2008/12/20 NOA1 Received

2009/04/28 Touched (Detail info did not change. Just the date has changed. NOA2???)

2009/04/29 NOA2 Approved (Received email notification)

You would "withdraw the petition" by writing the service center where it's being processed.

Nothing will happen to the Beneficiary.

K visa holders have six months to enter the US from visa issue date.

1) The beneficiary will be able to visit the USA just as before with a visa, or by VWP if that is an option for their country.

2) No difference, a K-1 is valid for 6 months.

Yes, you will be starting all over with filing an I-129F and paying another $455 FEE

Cancelling the petition now for personal reasons usually wont have an effect on future petitions. You simply explain the reasons behind the previous petition when sending another and file a waiver if requested by IMBRA laws. Keep in mind that if you are dealing with a higher fraud Country this may bring added scrutiny when at the interview stage.

A K-1 visa once issued has a validity period of 6 months. This means she must enter the U.S. within 6 months of the issue date of the visa itself.

The approved petition itself (NOA2/I-797) has a validity of 4 months. This means the beneficiary should be interviewed within 4 months of the approval. However, we all know it doesn't always happen that fast. It's very common for an Embassy/Consulate to extend the validity period as you are awaiting an interview date from them.

It is also sometimes possible to request a delay for the the interview yourself.

You must also keep in mind that an RFE and/or AP can hold you up at any stage of this process and for any length of time.

WHAT IF WE IGNORE THE RFE? DOES IT MEAN IT WILL AUTOMATICALLY EXPIRED AND HOW LONG?

COZ BF STILL IN THE HOSPITAL HE CANT MAKE IT COZ ITS COMPLICATED FOR HIS SITUATION...
