Hi. I am from Ottawa, Ontario, Canada and my fiancee (or is it with just one e?) is from Ohio. We met online through ICQ on December 2004. Met personally on May 2005, got engaged September 2005 and are getting married on August 26 this year. :)

I just joined up a couple of days ago because I am getting more confused and frustrated by the day on how long the K-1 visa processing is taking. My fiancee and I are planning to get married in Ohio on August 26 but the USCIS seems to be taking it's sweet time. I partly fault this on myself and also put blame on the embassy staff here in Ottawa, Canada. They told us that we can send the paperwork as late as April and it would be done way before our wedding. Lo and behold the paperwork reached NSC on March 22 and nothing "real" has so far happened.

So it looks like what is going to happen is that I'll still go down to Ohio to get married but soon after I'll have to come back and then my (by then wife) and I will have to fill out a K-3\CR-1?

How long does it take for the K-3 process to last before I can actually move into the U.S. and be with my (by then) wife?

If the K-3 process is all done and I am approved will I get a green card and automatically be able to work?

Please help me! :)

If your I-129F has not been approved by this time, you definitely will not have the visa in time for your wedding. :(

After you get married, your wife will have to file the I-130. This is the first step for a CR-1 application as well. If you want to apply for the K-3 (which should be faster but is sometimes not), then you'll need to submit an I-129F after you get the NOA1 (Notice of Action) for the I-130. I'm not going to go into details as most of the information is available by clicking on the Guides above. It is also helpful to check out the "Pinned" threads on the K-3 and CR-1 forums.

How long is the K-3 process? It's hard to tell. You can take a look at my signature below to see how my case is going. We applied for the CR-1, but 5 months into all the waiting, we decided to file for a K-3 as well.

Your last question... With a K-3, you don't get a greencard. A K-3 is a non-immigrant visa.

A CR-1 is an immigrant visa (therefore you get a greencard at the end).

When you get a K-3 visa, you'll have to apply for Adjustment of Status once you come into the US. You'll need to also apply for Employment Authorization Document which will allow you to work. Apparently, this takes about 3 months or so.

An alternative to adjusting status on a K-3 is to let the CR-1 processing take its course. This means that you'll have to wait for the I-130 petition to be approved, do all the paperwork and then come back to Canada for the interview.

I dont know Canada specificly... but everything has been on hold since March 6th. New laws and forms are to blame. I am getting work that a RFE's are being sent out. I think this is goods of progress.

You'd have to stay in Canada until you get your visa (meaning after your interview). The I-130 is just a petition from your wife stating she wants to sponsor you as a family member. Once that is approved, then you get to apply for an immigrant visa. The CR-1 takes longer to process sometimes (depends on your service center for the I-130, and how fast you receive and send back stuff to NVC).
