Not having a job at the time of the IR1 interview

Timeline

if my husband does not have a job at the time of the IR1 interview but has made more than 125% above poverty line for 2009 (also has made more than 125% above poverty line for the last 3 yrs), would that be okay? how much assets would we require to show if he does not have a job? what if he got a employment verification letter from his employer just before he gets laid off, would that suffice at the time of the interview along with w2 and tax transcripts for the last 3 yrs (if we dont mention to the officer that husband does not have a job currently)?

Would we still require a AOS co-sponsor as he may not have a job at the time of the IR1 interview. Is it a good idea to delay the nvc process till he gets a job as we may not have a co-sponsor?

There is now Adjustment of Status (AOS) for an IR1 visa. The only (AOS) in an IR1 case is the Affidavit of Support (I-864). This subject has come up several times lately.

Sheesh man, really. Nothing constructive to say" Try STFUing - it works wonders.

To the OP: Include all the documentation you mentioned; plus line up a cosponsor and send his/her info as well. Hopefully by the time of interview the sponsor might have a new job (let's hope so :yes: ) --- but you are better off having a joint sponsor ready. Best of luck in the job search.

your husband should get a job ... the docs appear to request past ... present ... future earnings. no job ... a co-sponsor will be good.

it's a tough spot ... I hope things work out
