Hi, first time posting here. This forum really has helped me alot in the K-1 Process. Right now, I'm about ready to submit my I195F package but I do have a question. I need to tranlate my fiancee's divorce certificate into english. I'm just wondering since I am proficent in both languages myself, do I still have to find someone else to do the translation?

Any document containing foreign language submitted to the Service shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English.

This is incorrect. If you're going to respond to a post PLEASE do your best to be sure the information you're posting is accurate.

The USCIS policy states only that....

"The person translating the document must certify that the translation is complete and accurate and that he/she is competent to translate from the foreign language into English."

as for me, I know English too but I used translator's services for translation of my documents in Ukraine, but I could do it myself. How I was said that it would be better if someone makes this translations instead of you. And of course a translator has to have a license or certificate. That's all.

I suppose you could do the work and have another person fluent in both languages, "certify" the translation as their own. However, at the Consulate level in Guangzhou, they are accustomed to seeing documents as official "Notarial Translations" provide by the local Gong Zheng Chu. You might get by translating the divorce decree but not the later docuements required for the interview.

See this document for the kinds of additional documentation you'll need. No matter what you submit with the petition, I would have Notarial translations of all official documents available for the interview. Note that when this document mentions "local notary public" it refers to the Gong Zheng Chu.

Good question. For the divorce decree, he might get all the way through the Consulate without a Notarial translation. However, he must have Notarial translations of all other documents actually submitted to the Consulate. So, "accustomed to seeing..." was used in the context of the divorce decree and "going to need" in the context of the rest of the documents. My advice is to go ahead and submit an non-notarial translation of the divorce decree with the petition but to get all documents translated at the Gong Zheng Chu, including the divorce decree, before the interview.

The OP's question was pertaining to the original filing of the petition in which USCIS clearly states their policy.

However, pushbrk is right in that when the time comes it's important that THIS OP understands that dealing with GUZ is going to be an uphill battle. There will be added requirements as well as added scrutiny at the interview stage for sure. It's best to prepare yourself as early as possible when dealing with a high fraud Embassy.

Joe & Nadya, because you decided to use a translator for your own petition does not mean that the answer to the OP's question is 'yes' like you stated. A translator does not need to be certified for uscis purposes. It's really that simple. Anyone else coming in here is going to look at these threads for answers to their own questions and it's imporant that accurate information is posted for that reason. We are dealing with people's lives here.

Anyways, I dont need a GUZ for now, but my fiancee probley will need one for the interview later?
